I am based in Cornwall/London but anyway this is countrywide. I tried the local police and they did not understand the law - they said we should pay the PCN ?!0

TerriAkers68 said:Hi, my name is Terri and I'm trying to organise a campaign to put a stop to the unscrupulous practices being used by the private parking company VCS Ltd (Excel) in and around the BP petrol station forecourt at East Midlands Airport in Derbyshire.
I was caught there in November 2019 dropping off a friend whilst I was using the station to fill my car up with petrol and I subsequently received a £100 PCN through the post. I went online and was horrified to discover that there had been a whole line of others before me that were caught out under similar circumstances. After doing some online research (inc. extremely useful info on MSE/Pepipoo) I followed the appeals process and my first appeal to VCS was successful. I have no idea why but assume that it was because I worded my letter in a forthright, techno-jargon, legalese type of way that probably just scared them off. Despite my success, I went to the paper because it's about time somebody tried to do something about this.
The EMA petrol station saga has been running for the best part of 2019 and the stories in the local press are the tip of a HUGE iceberg. People are now coming to me for advice and some are extremely distressed. Some of the stories I'm hearing are unbelievable. It's all very well saying "Oh it's that notorious petrol station at the airport, what a shocker" but no-one is challenging it and people just continue to get victimised. It was only a matter of time before VCS ran into someone like me that can't abide injustice and the fact that normal law-abiding citizens are being thoroughly ripped off.
My next move is to write back to VCS to inform them that I am on their case, just so they are aware. I will then write to the IPC and hopefully enter into a conversation with them about it or I might just jump straight in with a formal complaint. I strongly suspect that VCS are breaking the terms of their IPC membership by not following the Code of Practice. I also want to take this to Watchdog as I know they did a piece on VCS a few years back but times have changed, laws have changed, and a fresh look at the problem is required.
Please can you offer me any advice as to how best to proceed. I know that you have been involved in other campaigns up and down the country and I must admit I could do with a little support and guidance from people that know how these things are done. I had another story in the local press a couple of days ago.

Cheers, Terri
This is my post that I put in Debt-Free Wannabe forum:Hi, I've just run a credit report for a mortgage application and I've found a court entry against my previous address. Apparently at the end of March 2021 the court has issued a CCJ for not responding. I moved houses two years ago.
Digging into what the fine is for, the parking people at the EMA airport took a picture of my car while I was in the petrol station paying the bill for refuelling my car. The picture shows my passengers taking their luggage from the boot of my car.
Claim details:
THE CLAIM IS FOR A BREACH OF CONTRACT FOR BREACHING THE TERMS AND CONDITIONS SET ON PRIVATE LAND. THE DEFENDANT'S VEHICLE, WAS IDENTIFIED IN THE FUEL STATION, EMA ON THE XX/12/2019 IN BREACH OF THE ADVERTISED TERMS AND CONDITIONS; NAMELY STOPPING TO PICK UP/ DROP OFF IN A RESTRICTED ZONE.
THE SIGNS SPECIFICALLY DETAIL THE TERMS AND CONDITIONS AND THE CONSEQUENCES OF FAILURE TO COMPLY, NAMELY A PARKING CHARGE NOTICE WILL BE ISSUED, AND THE DEFENDANT HAS FAILED TO SETTLE THE OUTSTANDING LIABILITY. THE CLAIMANT SEEKS THE RECOVERY OF THE PARKING CHARGE NOTICE, CONTRACTUAL COSTS AND INTEREST.
The lady taking payment for the fuel warned me about the CCTV/pictures being taken and told me to retain a copy of my fuel receipt, which I did.
What would you do in my shoes? Is a picture of a person taking luggage of the car sufficient to fine someone for dropping people off/picking up? I visited the petrol station for a legitimate reason, I wasn’t parked or stopped on any double yellow lines but as everyone else by the fuel dispenser. I am tempted to apply to set aside the CCJ judgement and provide the fuel receipt as my evidence of no wrong doing.
Is there a way of recovering the £255 N244 form costs from the parking people/their solicitors as I think I’m being victimised here for no valid reason and no sufficient evidence?
Many thanks!

You would be well advised to either start a new thread of your own or send a PM to @TerriAkers681

And if you have a CCJ, read how to set it aside, in the NEWBIES thread post #2, top of this forum board. You can do control & f on a laptop keyboard when looking at the NEWBIES thread and put in CCJ and you will get to the right section in seconds.
WE WILL NOT LINK TO THE NEWBIES STICKY THREAD. MY SIGNATIRE ALREADY SHOWS THAT THERE IS A LINK, TOP OF EVERY PAGE. HOP BACK TO PAGE ONE OF THIS SUB-BOARD AND THE NEWBIES THREAD IS ONE OF THE TOP ANNOUNCEMENTS.
The Debt Free Wannabe forum don't realise that parking firm CCJs get set aside almost 100% of the time because they love sending claims to old addresses, knowing victims will panic when they find out and then pay in full, wrongly thinking that will remove the CCJ. In fact, that cements the damage in place on your credit rating with a permanent (satisfied) CCJ wrecking it.
NO PAYING IT.
NO RINGING THE PARKING FIRM.
No need to ask what your chances are, read the NEWBIES thread and any other set aside thread, we have more than one per week and you should read the latest ten or so. You will soon be well up to speed - and send a SAR to the parking firm for all the photos and letters, that will assist you when it comes to the hearing of your set aside application
Start a new thread here only when you've read the NEWBIES thread set aside CCJ section, plus at least 10 CCJ set aside threads. It saves us so much time when people have read around the subject for a couple of days and it will give you confidence and knowledge of what to do.PRIVATE 'PCN'?
