Well if the money was there to pay it......where is it now? Surely still available no? Are have you made a 'mistake' and spent it.

They have the right to be paid for the service provided....you haven't pait it. It's that simple.

September 2018 I renewed my home insurance with the insurance company, whom I have been with for many years. DD is set for 4 payments a year, they take the 1st instalment as I renewed.
September 2019 I renew again, and again DD is set for 4 payments a year they take the 1st instalment at renewal.
Mid Dec I receive a letter saying my card set up for the DD is about to expire and could I send details of the new card.
I then get a letter saying that I owe £348 from the previous year (sept '18-Sept '19) due to an error on their behalf!
So when I phone them up to give the new card details I mention the other letter about the £348 asked why it happened (my card details were ok at that time) and I didn't think I should pay as it was their fault, they then agreed to reduce it to half. But I need to know if I am legally obliged to pay this now, they didn't find this amount missing when I made my renewal in September 2019.
    TYIA for any helpful advice

Well is it a DD or a continuous payment authority . You can't have both.

The fact they did not receive the money was not my doing, it is on them to claim the money as per our agreement. The money was there for the taking, I did not refuse to pay.
It took them over a year to discover their mistake, and now they expected me to pay up at the moment they ask for. I wanted to find out my rights before I agreed to anything.
FYI I do a comparison every time a policy comes for renewal, I have changed energy 5 times in the last 6 years.

How could your rights be anything other then to pay them for the insurance you have received?

If you owe someone money they generally have six years to take you to court if you refuse to pay them back.

You do not have any right to get out of paying the money you owe, irrespective of whether they should have taken the money through DD. When they didn't, that's your responsibility to keep the money to one side.

You have the the right to ask them for a reduction or a payment plan, but they don't have to agree to it. If you literally can't pay the money right now I suggest you work out what you can afford and work out a payment plan with them.

Putting your head in the sand will not make the debt go away. Refusing to take responsibility for your side of the mix-up will not get you anywhere.

Why so sarky? I came here being polite and hoping for a discussion on a situation I find myself in through no fault of my own. But no, I just got remarks to provoke me into rising, sorry I don't feed the trolls :rotfl:
    What a shame

No, you came on here looking to get out of paying something that is legally due. You were told that early on but still bleat "it wasn't my fault".

To be fair, it seems from your opening post that you was looking for confirmation that you don't have to pay rather then anything else.

What answer would you like? Then, perhaps someone will provide it for you. It's often easier that way rather than disagreeing with answers you don't like.
