UKPC Parking Charge

Hello,
a letter has been recieved from UKPC on Friday 03/01/2020 regarding a parking charge dating back to 07/12/2019. at the Fountains Retail park in Tunbridge wells.
The car it relates to is a company car so it appears that UKPC have raised this with the leasing company who subsequently gave them the Keepers details.
Google maps shows that signs do exist though the driver does not remember seeing them
The letter claims that "the recorded duration of the stay was 3 hours 33 minutes which is in excess of the maximum stay of 0 Hours 0 Minutes"

Is either the time elapsed between the car being parked and receipt of the fine or the failure to correctly state the maximum stay on the letter, grounds to appeal the charge.

    It is not a fine.

    Appeal using the edna basher template for hire/lease cars you will find in post 1 of the NEWBIES. There are three to choose from but one is for fleet managers so you need one of the other two, whichever is appropriate.

    If/when it is rejected then make a second stage appeal to PoPLA.

    What happened when the lessee complained to the landowner?

    Have they complained to their MP yet about this unregulated scam?

    Have you told the lease company not to pay the charge under any circumstances, and that the hirer/lessee is dealing with this?

    Neither are what will win at POPLA, but the fact they (probably) have not included a copy of the documents that MUST accompany a Notice to hirer, will. As the NEWBIES thread explains, in the section about company or lease/hire vehicles and where links are given to 3 examples of how to appeal as 'hirer' (NOT DRIVER).

    Looking at the Newbie Thread (again) i cant see what documents should have been sent and in most cases haven't.

    The lessee has not complained to the land owner yet as they have not found the landowners contact detials yet.
    Havent complained to MP yet
    Lease company has been told not to pay etc.

    Thanks for the pointers, I will use the Edna Basher template as advised and let you know what happens. :)

    DO NOT send it so soon that they address the issue and send a new NTH with enclosures, of course, but that's obvious stuff.

    The PoFA tells you what docs the scammers must include in order to hold a hirer/lessee liable, and it is very rare for any of them to get it right.

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Yes. 35 days
  • It has been 36 days since the 21st Jan (if I count correctly) does this mean i am in the clear? do i need to do anything else at this point?
