Newbie- please help!

Hi All,
Advice needed please!

My husband parked on a car park twice in December and paid what he thought was the car park pay and display machine. He had two fines come through and it turns out he had paid the adjacent car park machine (silly I know) but it was right next to it and not separated. He tried to appeal and it was been declined.

We now have fines of £60 and £100 to pay- should we be liable? I have Googled the company name and the reviews are awful and it looks like their signage is poor and it has happened to loads of people.

    What happened when the keeper complained to the landowner?

    If/when the appeals are rejected then read up on what to do next.

  • It says the appeal has been unsuccessful- they have no recorded of the payment and they do not manage the car park by pay and display. They say there are signs clearly erected in the car park to use the phone and pay system in place

    Can we have the whole story please? Nowhere did you say you had appealed and it's still not clear what you put in your appeal.

    We can only give advice on the information we have got so the full picture would be useful.

    It is not a fine, it is an invoice from an ex-clamper to compensate them for the alleged harm they suffered when your husband did what he did. We call it a scam. Pay them not a penny unless a judge so orders it.

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Was the driver's identity revealed in the initial appeal? I hope not.

    Did you get a PoPLA code with the rejection? If so then use it. Construct a draft appeal using all the template points available to you from post 3 of the NEWBIES. Post it here for checking before you submit it.

    Get pics of the site and signage as soon as possible to support the appeal.

  • Sorry yes it was. He did the appeal by himself rather than look at the advice on here I am sorry to say. Well for one of the fines. Is all hope lost? He basically just said he had paid and sent proof of the payment (which was the wrong machine it turns out)
  • Thank you for all of the advice- should we be treating these as two separate appeals? One of the one already responded to and the other that hasn’t?
  • Yes a code was received with the rejection letter. I have read stories online of people getting CCJs from this company which I think has sent him into panic mode. I plan to go down there myself later and take some photos as no signage can be seen on google street maps
