Hi,
It isn't clear from your post if residents were consulted or not about the parking being introduced in your area.
I would suggest contacting the property management company to see if they actually went ahead and consulted residents. If not then it's possibly unlawful of them to engage the parking firm.
I would maybe hit them with a hard nosed email to see if they can leverage the parking firm to do the charge.0 -
So I understand from the leaseholder that there were lot of parking complaints at the time from the resident. And CPM was brought in response by the managing company. The parking complaint at the time was caused by builders (who were developing a land adjoining our property which can only be accessed through our parking space) using parking bays without any control. But in line with the quality of the managing company, CPM was only introduced after the work was complete.
Nonetheless, leaseholder is sure there was no change to leasehold agreement.
A strong worded email is sent to Optivo's Head of Home Ownership today. Hopefully, there will be a reply next week.0 -
Optivo (Management Company and Landlord) replied as followingAs you were ticketed at a time when no valid permit was displayed I will not be able to intervene on your behalf. I am not disputing your right to use that space but the only way for the parking enforcement company to be able to operate effectively at this development is if everybody displays their permit in accordance with the rules.
I will ask CPM for details on how these rules were communicated to the residents of [redacted] and [redacted] will get back to you when she returns on Wednesday.
I appreciate that this is not the response that you were looking for but regrettably there is no way for me to have this ticket cancelled.
I feel I am speaking to a brick wall when speaking to Optivo. As I feel there wont be any further progression with them as they seem to think that its not their "responsibility" even though they were the ones who brought in UK-CPM, I am planning on raising a case on Housing Ombudsman and then subsequently make a court case against UK-CPM and possibly Optivo for harassment and negligence respectively. Would there be a case for this? If you could share some of your wisdom on how best to proceed, it would be much appreciated.0 -
Not true, they could put all the residents' cars (those who have applied for or been given a permit) on a White List. Job done. If they are truly there to protect the residents' interests this is what they would do. Just to bring closure, I got the PCN cancelled last week as Management Company stepped up. However there is growing anger with how management company operates which is another fight to battle...!
I have submitted a case to DVLA for UK-CPM requesting Keeper details when they were in fact trying to invoice the legal holder to the parking bay. And I am planning on sending a letter to UK-CPM to delete any data they hold with regards to this PCN.

Many thanks for the advises and support. Looking back, I think I would have just paid the illegal PCN if I didnt find this forum!
There are some residents who think the PPC is useful in managing unauthorised parking (we have an issue with the parking gate where it sometimes doesnt close..) so I guess its bit of residential politics to do now! But there should be no room for PPC's fining the legal leaseholder... Interestingly MC are not really fan of PPC so getting them to remove them should be straightforward and its just matter of consensus among the residents..
