Speeding Six Months Ago

I was caught speeding 42 in a 30 on 2nd July 2019. Was a genuine mistake. The limit changed from a 30 to a 40 and the police were stood just in front of the 40 sign. I thought the limit changed further down the road. I admitted everything and the police gave me a long white ticket which says Part 2 Driver / Keeper Copy Traffic Offence Report. I was told i would receive a letter in the post. I have not moved house recently and all my details on my license are correct.

I have called the Driver Diversion Team phone number on the back of the ticket a few times but they say nothing has been received by them from the officer.

I have read online there may be a six month time limit after which the police can not pursue a prosecution? Is this correct?

So for example if i was to receive an offer of a fixed penalty later, could i refuse the fixed penalty and not be taken to court?

Basically i want to know if i have been lucky and got away with that one?

    Doesn't matter, since they were stopped and given the NIP at the roadside - their details would have been checked and taken at the time.

    Yes - they have six months from the stop to launch the prosecution. After that, they're out of time and cannot prosecute.

    You could well be lucky, happened to me I forgot to send my license off.

    What do you mean by this? No one has asked OP to send license anywhere yet and won't do until any conditional offer is made.

    If you mean for address purposes then the one that matters is the one on the V5C as they need that for the address of the car- the license address relates to a person and one hasn't been nominated yet to prosecute.

    Umm, the OP was stopped roadside - hence 6mo - they're not in the 14 day wait for an s172 request from a photo...

    Sorry, my answer is a bit confusing- I was replying to someone saying they didn't get caught as they didn't send their license off - but OP has no reason to send his license off anywhere yet and just needs to wait out the 6 months.

    Don't celebrate too early though, they have to raise the requisition/file it with the court wthin 6 months. I would wait until 7 months before breathing a sigh of relief. You might be ok, as 42 would have just been within the safety awareness course limit, and that would normally be offered.

    But it's far too late for a course or fixed penalty offer. Court action is the only possibility remaining.

    Indeed. My meaning was that since no course or fixed penalty has been offered, then it is likely that the paperwork has been lost or not submitted.
