Sainsbury's Euro Car Parks

Hello all,



I have browsed the previous threads and the newbie advice but I don't think any quite fit my problem.

I returned home from Christmas visiting to a Debt Recovery Plus letter - demand for an unpaid PCN £130 from September. This is the first I have heard of it. At the time, I had just moved house and they mentioned having to trace my details as if I were a criminal. ( I did change the registered keeper's address at DVLA as soon as I was able).

I had to do my homework and worked out it was for my local Sainsbury's car park. There was no mention of how long I had overstayed or any evidence to show this.

My question is what is my first step? Contact Sainsbury's CEO or the store Manager? Appeal via Euro Car Parks website or contact DRP?

    The NEWBIES answers all your questions. Your case is no different to anyone else's.

    Edit your post to remove information about who did what. Only ever refer to The Driver and The Keeper who are two different people.

    Always complain to the store manager and/or the CEO. Include receipts or redacted card statements to show you are a genuine customer.

    Send a late keeper appeal as per the NEWBIES and add a one liner stating that the NTK was never received as the keeper moved before it arrived.

    Ignore debt collectors.

    Do not reveal the driver's identity in any correspondence.

    I didn't feel the thread did answer my questions though, as I haven't received any previous warnings and so have been leap frogged further along the process and so will have missed any deadlines to appeal to Euro.

    Is the car park an exclusive Sainsburys one, or are Sainsburys just one of a number of retail outlets serviced by the car park? I don't normally associate ECP with being a Sainsburys parking contractor.

    Date of parking event?

    Date of house move?

    Date of updating your V5C?

    The car park I thought would be exclusively Sainsbury's as it is in a large, separate area, but it is known as Bolton Shopping Park so I assume they also run the car parks for the shops across the mini roundabout.

    The parking event was 25/09/19. The house move was officially 09/09/19. Updating my V5C was prob. early October.

    It's a strong possibility, given your description, that the ECP contract was with a managing agent rather than Sainsburys. You could try the manager of Sainsburys to see if they have any influence over ECP (be ready for any fob-off line, but if it's not Sainsburys car park, it's not Sainsburys car park), but as a minimum, try to obtain from the manager the name of the landowner and/or managing agent.

    If it is a managing agent contract with ECP, you're going to have to chase a complaint with the MA.

    You've been a bit unlucky on the proximity of the date of the parking event, your house move, and your updating of your V5C. But don't expect any sympathy from ECP - they will see it as their luck, meaning you've missed out on getting a POPLA code and your opportunity to get this cancelled at POPLA.

    You could try a belated appeal as per Fruitcake's advice (should it go to court it will show that you have tried to engage in ECP's process - albeit delayed through no fault of you own), but beyond that it's a case of wait to see what further action ECP might instigate.

    But as DRP are involved now, you just ignore them, they have no capacity to do anything other than issue silly letters. Rea the NEWBIES FAQ sticky, post #4 about debt collectors.

    What utter nonsense.

    How do you explain someone getting a CCJ and being made homeless as a result of a PCN when the car did not even belong to them?

    What about a PPC that changed the timestamps on their photos to make it look like people parked longer than they really did?

    What about parking companies that don't have planning permission for scameras or advertising consent for signs, the latter being a criminal offence?

    What about scammers carrying a portable no parking sign, placing it next to a car, taking a picture, then taking the sign away afterwards to reuse elsewhere?

    What about companies issuing tickets on a public highway?

    What about companies issuing tickets where they don't have a contract with the landowner?

    What about unregulated scammers using ANPR scameras that don't record parking time. The UK government has declared these unfit for purpose and banned their use in council and local authority car parks.

    All of the above and more has happened, and many of these activities are still happening.
