    I'd agree that i can't see a court awarding costs for set aside.

    Trouble with a contested set aside is that the PPC has procedurally not done anything wrong in gaining judgment.

    What about if the original PCN dates back several years and the PPC has received no repies..  Does it not have a duty of care to ensure that it is using a current address.  Especially if the motorist can be traced by the electoral roll or 192.com

    Update - I've requested consent for a set aside and the legal firm have written a letter replying saying that they will consent to a set aside, once full payment is made. Do I therefore go ahead and pay them in full as requested(I can't see that I have any other choice, and then hope they stick to their word?)  
    My only aim /hope realistically with this case is to pay the full amount due to the legal firm/PPC, then pay £100 for a consented set aside and hopefully win that as well?
    As I'm new to this and trying to avoid legal fees by doing it myself is there anywhere I can go for advice, somebody to read/check my defence/forms etc - this forum is amazing, but I don't want to be posting too much of my personal details on here. Thanks

    You need to get them to sgn the consent order. Have they written one or will you do so?

    Search the forum using the words set aside by consent and see what others have done, this is not the first time this has occurred.

    I've not written one, I was expecting them to do so? So do I pay in full now or get the consent first(if they agree?)
