Awarded LWC but...

I wan my appeal on 12/12/19, got into the LWC group then received an email then a letter of confirmation. Last week, I received a WCA letter for 3/1/20. I did phone explaining this could be an overlap and the chap I spoke to said they’d need confirmation of this otherwise I’d have to go to the interview and my money would be stopped. I left a concerned note to my UC work coach, she wrote back she’d emailed head office to notify the correct people. The opening times are shortened due to Christmas and new year so I’m worried they don’t receive the confirmation email/phone call and I have to go again to these blasted things.

    What was the reason for the Tribunal, were you found fit for work and were you claiming ESA before UC?

    Yes, found fit for work, it went to a tribunal and was awarded it. Claiming UC and sending in fit notes.

    Were you claiming ESA before you claim UC? if you were then the Tribunal was for that previous WCA and as you claimed UC and sent in fit notes then that has prompted another re-assessment.

    I know you're not claiming it now but were you previously claiming it before you claimed UC?



    The reason i ask is because usually once you've been found fit for work they don't usually accept anymore fit notes.

    No, I have never been on ESA, UC only.

    Were you asked to complete a UC50 form?
    Normally these are requested in advance of the WCA.

    Your tribunal decision would have been based on your condition / abilities on the date of the DWP decision to find you fit for work. It was not based on your condition on 12/12/19 (You typed 2009, did you mean 2019?).

    When was the date that the DWP decision found you fit for work, which was overturned by the tribunal?
    Has your condition / abilities stayed the same / worsened / improved since then?
    What descriptors / points were awarded by the tribunal?

    I think you need to attend the WCA, but take a copy of the tribunal decision notice with you.
    Assuming no improvement, then explain to the assessor why and how you still cannot do these activities giving recent examples.

    If you go into the Job Centre on Monday with the Tribunal letter, they should be able to resolve. As long as the tribunal letter says you don't need to have a re-assessment for awhile, then this can be resolved before the 3/1/20
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    Apologies Alice regarding the date, I did mean 2019.

    Hucker, this is what I am going to do and hope it’s resolved and I don’t have to go for another WCA. At the end of the letter it states I have this award for 24 months.

    Since the decision to find you fit for work did you report a worsening of condition, which is why you continued to send more fit notes?
