    If something just moved in the middle of the night without anyone seeing how it got from A to B, even if B is only a few yards from A then surely it's not theft?

    And that's where Taking Without the Owner's Consent came in - because there's no need to prove an intent to permanently deprive.

    POFA2012 would also come into play - it's private land in exactly the same way as any carpark, and you can't just tow a car from there.

    Basically, I think the OP's a bit stuffed. If it genuinely is on private land, there's not a lot can be done about it without breaking various laws. Ultimately, it's no more than a trespass, but one which is protected by the fact it's a motor vehicle.

    Tongue in cheek but if you know who's parking there, then why not send them a communication stating you're offering to rent the space to them at some unreasonable rate like £100 per day and if they do not accept the offer, then they should remove their vehicle by x date and if their vehicle remains after that date then they are agreeing to pay the requested charges?

    If you made it a reasonable rate like £5 or £10 a day, it soon mounts up and you might get a small claims to succeed.



    But I bet you can't sub-let anyway.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
  • Can't you just tow it into the road and let the authorities take it away? They might know you did it but hopefully couldn't prove it.
