    Just to be pedantic and to clarify for you

    Was the PCN a postal Notice ? Ie , Notice

    Yes

    Did it come To the Keeper ? Ie To (the) Keeper

    Yes

    The capital letters are NTK ie Notice To Keeper , so it's an NTK

    It's that simple

    When the Mhclg sort out their CoP and hopefully clarify what words must be on documents , it may change for the better , but until then it's an unregulated cowboy industry , with volunteers like us helping others Wade through the mire

    After submitting my appeal through the PE online system on the 30th December 2019 I finally received a letter in the post today 22nd January (dated 17th January) from PE.
    PE advised that my appeal has been unsuccessful as I have not provided sufficient evidence that I did not break the terms and conditions on the signage. PE also go on to state that they are fully compliant with the BPA regulations on signage.
    On the letter I do have a POPLA ref number.
    Help and assistance on the next step to appeal to POPLA please.

    You have a PoPLA code so construct a draft appeal to parkinglie as hirer/lessee using all the template points available to your from post 3 of the NEWBIES.

    Point 1 should be non-PoFA compliant NTH and quote the relevant parts of the PoFA from paras 13 and 14, pointing out where they have failed to comply with the strict requirements of the said Act.

    Other points should include

    Not the landowner
    No standing to issue charges in their own name
    Inadequate signage
    Any BPA CoP failures. Make sure you check the correct version of the CoP as a new one was introduced at the beginning of this month.
    Anything else relevant

    Show us your draft appeal for checking before you submit it.

    What happened when you complained to the landowner?

    I cannot stress enough, do not try POPLA until you have exhausted the complaint to the landowner/retailer and Head Office/the CEO.

    A POPLA code will last just over 30 days (not just 28) so plenty of time.

    I did not complain to the retailer as the receipts from my purchases have long since gone - so not much evidence to back up my case. Having said that, I have shopped at that Supermarket regularly for over 10 years and given them several £k worth of business.
    I will try discussing this with the Manager of the store on the weekend.
  • Hello Coupon-Mad,

    The retailer is Asda, however, the car park is multistorey and two of the three levels are for Asda and the third is for the general public use and managed by the local council. The vehicle was parked in Asda's level with 2 hours free parking.

    I'm not sure but Asda probably lease the car park and so are unlikely to be the actual landowner. I will ask for clarification on this when I speak to the Manager on the weekend.
