I really wouldnt worry about the ESTA yet, that can be done 3 days before you go and pointless doing it now as you would lose 8 months validity on it if you arent going until August. Deal with everything else first.0

You will need your daughters passport to apply for an ESTA. I assume you will have that? As I recall the ESTA application does not ask for any address details for the applicant. Everything is in the her Passport or you will know as her father.
I would recommend that you apply for the ESTA ASAP in case there are any issues. If there are then you will possibly need to attend the US Embassy for an interview to obtain a VISA and that can take many months. As an ESTA is only $14 IMO it is not worth the risk of waiting to gain a few extra months. And, in any case, an ESTA expires with a Passport, so it may not last the full two years anyway!
Additionally if you take your daughter abroad you will need the written permission of her mother agreeing that she concurs. Or alternatively a Court order confirming that it is ok. See https://www.gov.uk/permission-take-child-abroad for details ps sorry if I am teaching you to suck eggs?
Remember, only use the official site to apply, there are many bogus sites that will charge a lot more than the $14 official fee.

I disagree.
Even when there are no potential problems with getting an ESTA, this should really be applied for and issued before anything else is progressed.
If the application is left until close to the time of travel and there is then a problem with getting it or the issuance gets delayed then it can jeopardise the whole holiday.
Yes, applying for the ESTA now means that 8 months validity would be lost but the cost of this only works out to around £7 which when compared to the cost of a holiday in the USA will only be a tiny fraction of the overall cost.0 -
I also think you should apply for an ESTA asap but there are many other issues to also sort0

thank you all so much for your help, after the first messages I got I didnt think anyone would give me any advice, and yes I am in court soon, I have applied for the court to grant the holiday, as the mother and I do not get on at all. thank you all once again0
