    Reply received from APCOA following 1st template appeal......

    APCOA Cancelled the PCN. Great result and thanks to everyone who helped with this, cheers all.
  • Tyserbans 20 or anyone please could you tell me what letter of defence you used. - Was it the blue template from the newbies thread? Did you amend it at all - and of course how. The blue template talks about a parking offence. Should I still use this for the below (not sure what they claim the offence was!) Should I start a new thread? I haven't found other similar "dropping off or picking up" at airport cases.

    The note received as a Keeper was for an APCOA parking charge notice at Luton Airport. In the opening paragraph it says "for the alleged contravention of dropping off or picking up outside designated areas at Luton Airport Central Terminal Area on 31st December".

    Below this it says in bold
    "The alleged contravention is a BREACH OF THE TERMS AND CONDITIONS OF USE of the car park. Signs are clearly displayed throughout the area showing these terms and conditions"

    The car appears to be outside the car park. 4 pictures were produced with not very clear pictures of the reg. The driver is not shown in any picture and a person is seen by the vehicle which has an open door - There are 10 secs between the first picture and third when the car is seen at a junction pulling away.

    I have read the blue template. There is no "close up actual photograph of the sign they contend was at the location on the material date". No mention is made of POFA but the Date of issue is of the notice is 14th January 2020 and so it could not have been received within 14 days of the alleged offence.

    Is the blue template the appropriate response? Should it be edited to take out the bits about length of parking or should it be submitted as is? Should the response also state it could not have arrived in 14 days and that the car appears to be on an approach road not in the car park.

    I would really appreciate any help

    this was an appeal , not a defence (it wasnt a court case)

    just submit the blue text template as is to APCOA , as keeper , if you are the RK

    if its a lease or hire vehicle , adapt an edna basher template

    do NOT reveal who was driving


    when you get a popla code , appeal to popla, using another LUTON or BIRMINGHAM apcoa airport appeal and adapt it to suit

    APCOA ones are easy as long as you don't say who was driving.

    No. Just copy the template completely. It sends them a clear MSE message!
