What penalty did the ICO impose on the company?
The ICO can impose penalties on companies that are in breach - however, there are different levels of breaches.
In this case the company was advised to change their procedures and to re-train their staff. However, the ICO will hold their findings of this case on their file and if the company is found to be in breach at some future point, then this case could and would be held against them also, thus more likely to have penalties imposed.0 -
You can enjoy your £350 OP, knowing that somewhere along the line the people paying for this "compensation" and other nonsense claims will be other customers.
I think this grabbing after every penny for every little hiccup or slight is distasteful and cheapens the concept of compensation for real hurt and distress.
I understand the point you are making. However, it is not the way I see it. The whole point is to get these companies to understand that the consumer has a voice. Now maybe in dealing with this case this company will tidy up its procedures and thus avoid a more costly case further down the line. So, possibly, their customers have been spared paying for a bigger payout..... and as customers, we get a better service.
I don't agree that taking a company to task cheapens the process or lessens the voice of the consumer. As I said, maybe it helps avoid a bigger issue in the future. However, where there is a greater degree of hurt, distress etc, the compensation should be at the appropriate level.0 -

£350 will have been less than their legal reps would be charging a hour if it went to court.
A breach is a breach is a breach .... there are different levels and different impacts as such.
Would agree their legal reps will be on a tidy sum per hour .... but if the claimant loses the case the claimant stands the risk of paying these fees ....0 -

So, if you get a text today out of the blue from a debt collection company demanding payment for money you don't owe, you would have two options:
Option 1: You would need to find out who the debt company is? Why they have your details? What details do they have? Where else have those details been passed? What impact is it going to have on your credit rating etc?
Option 2: Take the view Life is too Short, ignore it and hope it will go away.
Most people will take option 1. This is time consuming. It's concerning. It's frustrating being passed from pillar to post. etc etc.
When it is finally established what has happened, you will have two options:
Option 1. Accept it and move on, life being too short to do any more on it.
Option 2. Challenge the company for putting you in that position and request recompense for doing so. In addition, ensuring the company changes its procedures so the possibility of it happening again is reduced.
I am an Option 2 man.
Incidentally, what do you define as minor? Is minor just the passing on of my phone number? Would minor be phone number and email address? Perhaps it would still be minor if it is phone, email and house address? Minor if details passed but no loss?
As for me being perfect? .... Not yet...... but I'm working on it.
What will make me better at my profession is making mistakes ..... and learning from them!!

I never understand why people would use the ignore function, anything even remotely offensive posted on here gets removed. You must have a very sensitive disposition if you have to add people to the ignore list because you simply can't bear to read what they write :rotfl:0 -

It's not offensive posts I put them on for (well, not only), it's the trolls and general idiots. I wouldn't have thought I'd have to explain that but then again...
