Warranty - reasonable amount of time?

Hi,

I have Dishwasher that's been faulty for over a month now, and we've just had a failed engineer visit, so looks like we'll be without it over christmas.

I already have a complaint open, and was sure I found before that there was an obligation to carry out warranty repair "within a reasonable amount of time". Now i can't find that wording anywhere, can anyone help me out? I'm sure it was in something official like the sales of good act but i can't find it anywhere!

thanks in advance

Tom

  • If you are claiming under the manufacturers warranty than anything ‘official’ in the now superceded sale of goods act is irrelevant.

Even if you were claiming under the SOGA or CRA. A month isn’t that likely to be considered unreasonable as I assume you have a sink

Thank you, I guess we disagree on what a reasonable amount of time is in this case, but you pointed me in the right direction.

The wording I wanted from the Consumer Rights Act 2015, just in case anyone else finds this thread while looking for the same thing it's here:

I guess you're referring to 23 (2) (a) ... as Katrina says, being without a dishwasher is annoying but not an unreasonable inconvenience - dishes can still be hand-washed like they were before dishwashers were invented.

(If our's broke down we'd be annoyed to be without it, but we'd cope).

Are you saying it took an engineer over a month to give you a visit to sort the machine?

You seem to be confusing 2 issues. You mention warranty in your first post but your latest you are quoting CRA.

What are you claiming under? If warranty then what CRA says about 'reasonable' is irrelevant.

BoGoF, it says if you have a right to have an item that was faulty repaired, is that different to a warranty? If so is there similar legislation relating to warranties? It's about 9 months old if that makes a difference?

zoob, Yes, it's been over a month since it broke - I don't have the exact date but know it was before 16th November. The first visit was quite quick, within 4 or 5 days, I expected the next to be a similar wait, which we would have been OK with. Then nothing until about a week ago when we go the appointment for yesterday. (I did call them a few times and was promised calls back which never came). Yesterday the engineer came with a part that had already been unpacked, a piece removed and returned, so repair still wasn't completed. With the Christmas break I doubt this will be sorted before the new year now.

I know we can wash up by hand, but we spent £330 specifically so we don't have to. I accept these things do break but expect it to be sorted quickly and to be kept updated. Seems like I'm in the minority though and most people are fine with paying out for a product they can't use for weeks on end!

Ok, up to 28 working days is considered the max time to effect a repair of an non essential domestic appliance from first service visit
If it’s 28days or more phone the service company and ask for item to be replaced

Whilst I'm usually scornful of the "Christmas premium" that people seem to think exists, whereby they think their consumer rights are more important because it's Christmas, in this case, the OP has been mucked about for a while already so I can see why they're annoyed that they're probably facing at least another two weeks before anything's done.

    zoob, you're a star!

I've called them and a replacement request has been raised - I can expect a call within 24 hours...I have no faith they'll actually call based on their performance so far but it still feels like progress!!

    thanks for your help
