From what I have read, this new Scottish Act, whilst enacted, still appears to have no teeth - at least the POFA equivalent bit looks like that.
It appears to be in a similar situation to the Parking (Code of Practice) Act, where the Act is in place but no-one has yet specified what the detail is.

I suspect that they introduced it so that when the new Parking Bill CoP comes into force the idea of keeper liability would be true in all 3 countries
its a shame that this Scottish law has come out prior to the Parking Bill CoP arriving as they really needed to be in force from the same date (in my humble opinion)
the argument about whether the Scottish MP,s should have allowed this to happen is not one for me to muse over , but watching previous parliamentary debates over this it seemed that Scotland wanted this new Parking Bill in the Houses of Parliament to go through , so to me they are playing catch up with POFA
trouble is , we are now in limbo land awaiting developments by the MHCLG and the new free parking in hospitals for some people in England and Wales as announced by the Queen yesterday whilst sat on her throne doing the Speech
we need clarity, a new beginning , not piecemeal attempts with no joined up thinking
it reminds me of my wife going to work on the Stagecoach bus , she had to get off in a nearby town and get on another one for the onward journey (7 day bus pass for Stagecoach at the time , saver 7) , but the second bus she needed left a few minutes before her initial bus arrived at the bus station, where was the joined up thinking in that ?0 -

Hell, I'm still within the 14 day period on both where I could clear this out of my life for a bargain price of just £120 (lol).
Before caving in to a bully at the first threat why not search and search this forum (or any other for that matter) and find one single case where Smart Parking have taken anyone to court, let alone won there. Then make a more informed decision than a panicked knee jerk.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Whilst we believe the new Act is now law in Scotland, we have been told by another knowledgeable poster on another thread that the commencement date is in January.
We know very little about this new law and how it will affect Scottish motorists other than the latter will now have to tread lightly and be vigilant when parking.

If there is a lease firm involved, ALWAYS acknowledge the PCN and say you are the lessee/hirer (to stop the PPC illegally reverting to the Fleet Co).
And in all cases, ALWAYS complain to the retail park/retailer = the easiest cancellation known to man and woman! Works pretty much every time if you make a bit of a pain of yourself and make it easier for them to cancel, as long as you complain to the right party who contracted Smart.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
