nobody can answer those questions yet , because the change has only just happened, meaning there is no history to tell us what will happen and nobody with experience of this new system either
assume that it may go to simple procedures through the sheriffs court and plan accordingly, especially for the later pcn0 -

its the cost of the pcn , plus court fees and possibly limited legal fees , plus interest
in england and wales it equates to around £200 for one pcn, if lost in court
some of your laws are not the same as ours , especially this new Parking Bill your MP,s passed recently, plus your small claims system is also not the same, google it0 -
From what I have read, this new Scottish Act, whilst enacted, still appears to have no teeth - at least the POFA equivalent bit looks like that.
It appears to be in a similar situation to the Parking (Code of Practice) Act, where the Act is in place but no-one has yet specified what the detail is.0 -

So this could end up costing me £400 or more after all is said and done?!
Maybe best to just pay and save the hassle or potential headache...

You are at liberty to take that route and spend £120. Or you can gamble (with exceedingly good odds) on paying £0. (Smart have rarely taken anyone in England to court; as far as I am aware they have never taken anyone in Scotland to court).0
