    It all depends on the circumstances on test.

    In general, if someone is actually stood waiting as you approach and you don't stop, you will get a serious fault. Not illegal to not stop, but if that pedestrian was clearly present and waiting, they could easily have stepped out in front of you (I would do...).

    If you haven't seem them due to obscured sight lines on approach and then can't react, you should have been slower on the basis you couldn't see if it was clear (whereas most drivers slow down only if they can see it isn't clear, rather than only continuing at normal speed if they can see it is). Again, a serious fault would be anticipated if a pedestrian is present as sightlines improve, or a driving fault if there isn't anyone present.

    The grey area might be if they were walking towards the crossing as you approached. If you are both arriving at more or less the same time, fine. If the pedestrian is getting there first, would depend on just how much ahead they arrive.

    Nothing is black and white, fail/not fail, on a driving test not even failing to completely stop at stop junctions, contrary to common belief. Everything is assessed and taken in to consideration on test, speed, observations, general awareness, road conditions, other traffic, actual outcome vs ideal outcome etc.

    The examiner told me that had the pedestrian stepped out it would have been. He said that her observation saved me. I only had 3 faults.

    This morning I failed to stop at a zebra crossing with the flashing beacons and I realised the was a girl there waiting to cross.
