    Given that SMART PARKING have advertised misleading information which has caused the multiple reoccurrence of the ‘Insufficient Paid Time’ and caused distress to all parties involved, SMART PARKING has forfeited its right to Hirer liability.
    Smart never had any right to liability against anyone except the driver, as they do not use the POFA (their choice).

    That was the important point to get the Fleet managers to understand.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    This field is completely new to be and with trying to absorb all the terms and Jargon correctly, I may have missed that part out to correct , I take it that everything else written is ok.

    I have also gone through the NEWBIE Thread to find out if there is evidence to show the Landowners that they have the option to review and potentially cancel the PCN...this is causing a lot of stress.

    I take it that everything else written is ok.
    If you have not sent it to the Fleet Manager yet it is far too wordy. they do not need to be told anything at all about the car park signs.

    You should have simply said what we told you to say, about one or two paragraphs refusing to settle their error and telling them it was never their liability (I already typed what to put, yesterday, I'm sure).

    The Letter was actually sent for appeal to SMART which included the Permission Letter :cry:

    LEX Autolease have take accountability that it should not have been paid, which is why they have written up the appeal letter as they said that without the Permission Letter SMART wont even look at the appeal. Lex also mentioned they have 2 options which my other half's company could choose from either automatic payment system or to nominate driver. The company chose automated payment which then immediately deducts payment from salary without appealing. Lex have also confirmed that by the company choosing the automated payment, it does immediately forfeit Driver's appeal and accepts unlawful liability.
