  • You can attempt to request the name and address of registered keeper of vehicle from DVLA yourself using form V888/1 available from direct.gov for a small fee of £2.50. Provide copies of everything you have in relation to repairs etc to help your case as you need to prove reasonable cause to have details. If you need details on both reg marks then you'll need to fill out 2 forms and pay 2 fees.

    I'm not so long off the phone to my insurance and they have done nothing with the information I gave them two weeks ago and I was so so angry. I said that there was a confusion with the registration number and gave them the two possibilities, and they had only checked one and done nothing with the other one.

    They hadn't even contacted the police to get the details who had the correct registration number from CCTV footage. Basically they have sat on their laurels for more than (yes it was More Th>n) for more than two weeks. They hadn't even contacted my witness whom I gave them details for or the police constable who was dealing with it despite giving them her full name and badge number.

    After speaking to 3 Indians today I finally got the information through (I think) and they have confirmed that the offending car is insured with Admiral Insurance (total breach of the Data Protection Act telling me this, but alas they don't know our laws, which is a bit of a bonus in this case.)

    As for my excess now they have an insurance company to pursue (they could've had these details almost 3 weeks ago if they had got their fingers out), they say they will suspend my excess and will inform the repairer, and will speak to them about my lock and call me back in an hour. I'm still waiting and it's been over an hour although Hitesh was one of the better English Speakers and seemed genuinely sorry for me and actually understood what was going on. But why after more than an hour now is there still no phone call back and I'm no further forward. I really don't want to have to pay out this £250 and then wait what will seem forever to get it back especially if the other party disputes it.

    The general public have access to the car park via the shopping centre too, so you don't just have to access it from the outside of the building where you drive into it initially. There is an entrance to the car park via the shopping centres 2 floors, and then again from a separate stairwell attached to the shopping centre / car park to each level up to level 7 where I was.

    I would try to get the details from the DVLA of the address and owner, then pop round one night, and take pictures of the damage on the car.

    Surely if it was pulling front inwards, it would be on the front right corner, if it was reversing it would be the rear right side.

    My bet is that they did not get the work done to the car, and its sitting as it is.

    Could be worth following it one day, and when they are away, get some pictures...and leave them a note asking them to contact you about the damage they caused to your car on XX/XX/XX at XXXX location. Inform them that you have there details, a witness etc. Leave a contact number and see what they say to that..

    My bet is that they are local..

    Apparently they drove into the parking space, so the damage to their car would be on the passenger side front as it was my drivers side back corner / door which was damaged.

    Just contacted the police and asked for further information to pass onto my insurance company and they cited the Data Protection Act and it all has to be done to my insurance company and my insurance company has to pay for the police report and they are just trying to get out of it by getting me to do the donkey work.

    Oh Indian Call Centre told me they are insured with Admiral - mmmm I see they know nothing of the Data Protection Act eh?

    Think I will invest the £2.50 for the car details and drop round / put a note through their door telling them exactly what I think of them.

    As for where they stay it's "apparently Newport, just across the Tay Bridge" and like I said I'm sure I could trace their car very quickly just by having a drive around unless they have it garaged.

    As for getting it repaired, yes it's possible it's been repaired as it's been almost 3 weeks since the accident (tomorrow), but on the other hand, if the damage is not too bad to theirs, they might still be driving around with it.

    I'll keep you posted (4.30pm now and it's been 3 hours since Hitesh said he'd phone me back, and I've already phoned them to chase him up as Courtesty car is due back very soon).

    Edit - just phoned the repairer to see if they can chase things up. Lovely lady called Jane is going to see what she can do and agreed the Indian Call Centres are useless (no disrepect to any Indian's reading this as I actually feel sorry for the grief you guys get from us, but it's so frustrating from our end.)

Your insurers said the other one was uninsured (indicating it might not even exist). You can phone DVLA with both and ask if they are in use. we know one is in use, but they will tell you if the other one is in use or not.

    About the £40 door lock, that should be included in the repair bill, and paid for by the insurers, it is a consequential loss as a result of the accident/repair, ask your insurers for a refund of the cost.

    Wig once again thank you for your time and effort, your link above comes up as expired, but if i go to the DVLA site and enter it into the Vehicle enquiry page using the registrations numbers and put in Ford Focus as a make and model as it requests this, it comes back with when the tax is due for one of the vehicles recognising it as a valid car. Tax due March next year and apparently its green not silver.

    The other just comes up with the message :-

    Vehicle details could not be found

    As it has not been possible to locate the vehicle details, your enquiry cannot proceed and has been cancelled.

    If you want to check the vehicle record held by DVLA...

    Update re phone call - well it never happened, didn't get a call back, so had to phone India again. Again the girl Kathleen was lovely (strange name for an Indian though) and she assured me that the garage had been informed about waving my excess. I had the garage on the mobile at the same time and they said nothing of the sort had come through in a fax as I was told. Kathleen said details had been passed on at 1.30pm to repairers.

    Grrrrrrrrrrr repairers very understanding and have let me keep the hire car another day and Kathleen assured me she would send the fax personally and phoned me back to say she had done so. Garage never called back to say they had received it but did phone me 15 mins after to say still no sign of it and it's a common problem saying they have sent details when they have not. Makes you wonder what you pay your money for when it's you doing all the leg work!

    I've been promised a call back on Monday re the door lock, and I never thought about saying it was a consequential loss, good thinking Wig!

    I just want my own car back, need to tax it tomorrow, but do I when I don't even have it back yet, and think it's too late to sorn now.

    I'm so stressed out right now with all this and have already been at the chocolate in copious quantities which really doesn't help!

    The saga continues................................ Next time insurance due for renewal, criteria might will not be price, but where their contact centre is based and is their first language English which I feel sounds really racist and I'm honestly not but this is rediculous. Is it just me who feels like this?

    Oh and I've to give the police officer a call tonight about the incident to see if she can tell me what is happening to the other driver. Fingers crossed they are getting done for it, at least some of the hastle would be worthwhile knowing they are not getting away with it.

    The problem in your case is the car park has more then likely not been deemed to be a Road under the road traffic act and therefore one cannot have a Road Traffic Accident or face one of the above charges. I have put a link into the Stated Case which defines a car park as not a road.

    The first case you linked to is the House of Lords appeal which overturned the decsion of the second case you linked to.

    However that was back in 1998, I think there has been new legislation since then to include car parks/land which the public has access to, but I am not yet sure what the legislation applies to. i.e. the rquirement of insurance or the liability of motor insurers.

    But the OP should not be put off by this, because there is still in any event a civil liability even if there is no criminal liability. It could, however, be argued to be "criminal damage".

    To cheekyweegit,

    If you want to be sure about the other registration, the DVLA will tell you on the phone if it is "in use" or "not registered" i.e. it does not exist.

    Maybe better to use the term "integral cost relating to the repair" rather than "consequential loss" consequential loss implies an uninsured loss.

    My first step would be to track the order, and get proof that they caused the damage.

    If you can prove this, with the witness statement, photographs, CCTV footage etc, then i would go with passing this information to the insurance company to get it all back, then from there pass all the information to the police officer who has dealt with the case to push it forward for the criminal damage, leaving scene of accident etc.
