VCS are getting away with this frequently.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I had to show proof that I had sent the email which I duly did. The judge didn't wish to postpone it but the rep said she couldn't go through everything in an hour. In terms of costs, judge didn't give any despite my protestations.
I feel the judge was quite rude until he found out I am an nhs worker.
He ordered for the documents to be emailed and served via post within 48 hours which was carried out.
A fellow NHS professional getting hassle from these scammers!
Is the stress affecting your clinical practice and/or reducing your ability to complete clinical duties? Might be worth mentioning to the judge...

Excel/VCS said that they had not received some pages of my defence. I was sure that they had.
I have noticed that there are different names appearing in their "litigation department" on a regular basis. That would indicate a high staff turnover of the people that deal with the litigation paperwork which may be why there are issues with missing witness statements etc. This is not a company with a good ethos so likely to have a high staff turnover.
There has also been some mix ups with paperwork going to the wrong person or that mentions other defendants.
They have been sloppy with paperwork in the past but have been worse since the pandemic.

Currently preparing for the hearing and I've realised that I've not included part of the POFA that I'll be relying upon - specifically subsection 5 of paragraph 8 of the POFA. Will the judge be prepared to look through the whole POFA if I print it out?
My main points will be:
1. Poor signage
2. Lack of adherence to POFA- red card being NTD
3. Double recovery
