Highview Parking - PCN rec'd, appealed, further letter seems to ignore appeal

Hello all. Newbie poster but have read the newbie thread, etc.

This is for my sister-in-law. She got a notice from Highview Parking for an overstay of <20 minutes (on a 3 hr max) at our local retail park. We followed the advice in the sticky and sent the blue appeal text using their online form. We took a screen shot, capturing the date and time on my PC.

She has now had a further letter from them saying that the fine has risen. It makes no reference to the appeal sent - it's as if they are claiming they never received it (the form most certainly worked!).

I was kinda expecting a rejection, POPLA, etc, but what do we do now? Ignore, or send further info, including that screenshot?

I may get her to complain to the landowner too (hadn't thought to do that at this stage). Is there any wording on that, or just free text complaint?

    Free text complaint as keeper, no blabbing about who was driving , the royal WE works

    Also appeal online again with the blue text template , as Keeper , asap

    Add a paragraph stating that this is the second appeal that has been made (see screenshot) and a complaint to the BPA is being considered ,plus that the landowner complaint is also being made

    In future , item number one is a landowner or retailer complaint , before any appeal is made

    If it's past the 35 day deadline for a response then complain to the BPA. If it isn't then wait.

    It is not a fine, it is an invoice from an ex-clamper to compensate them for the alleged harm they suffered when you did what you did. We call it a scam. Pay them not a penny unless a judge so orders it.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    To clarify, the alleged "infraction" took place on 9th Nov, the first letter was received on 23rd Nov (so meeting the 14 day thing right?), asking for £60 (reduced from £100). We appealed that same day, online, as mentioned. Have a screenshot.

    Yesterday, a further letter was received saying that as no appeal or payment has been received, the amount "owed" is now £100. Side note - the letter seems to have made a mistake, in that it states that they "...offered to accept a reduced amount of £100, if you paid within 14 days". That number is inserted within a pro-forma but surely it should state £60, the original invoice amount?

    Anyway, today, we emailed the landowner, who rather helpfully said "nothing to do with them" but directed us to another email address which we forwarded our complaint on to. Awaiting any reply there.

    We also appealed again, as advised here, using the blue template and added a bit about already having appealed and uploaded the screenshot. The online process clearly stated "we'll get back to you within 35 days" etc.

    So I guess we now wait? I must say, this is the first time either myself or my S-I-L have gone down this route and it makes us nervous. I know that's what they want but I assume you've all got our backs, right?!

    we have your backs , yes , so sit and wait , but keep copies of everything in case you have to complain to the BPA

    THE CHARGE HAS NEVER RISEN

    it was always £100 with an early payment discount of 40% , so yes , £60

    once the deadline passes , the discount ends, but the charge is always what the signage says and £100 is the maximum, so it was always £100 as stated on the NTK

    the landowner is telling porkies, they have the power of veto, but as this is only tame Highview at least you are learning about this sc@m with them and not Parking Eye

    wait for whatever comes back, or after 35 days complain to the BPA

  • My sister in law tells Highview have asked for receipts from her transactions that day in the retail park. I assume this is a bit fat no? I mean, even if it was a legit request, I doubt I'd have receipts from a month ago,even if it was any of their business.

    Weirdly, they have also asked for copies of the letters they've sent her?!

    proof of patronage is not unreasonable, if you or she can find the proof, as in receipts or redacted bank statements , pluis they cannot now deny having received an appeal seeing as they have responded

    my S I L had her pcn cancelled by Parking Eye after copies of receipts were passed on (a few years ago now)

    perhaps they want proof of I D that she is the person who is named in the letters ?

    again , no reason why this could not be done , as an OCCUPANT and KEEPER of the vehicle, doesnt mean she was the driver

    her choice to decide if to pass these details to them or not
