Hi,
I have followed all the tips, email the DPO of Wing Parking ltd, complain to DVLA and BPA. Nor have replied/answered but I just received a 2nd letter from QDR Solicitors requesting full repayment otherwise the matter will be pass over their 'Litigation Department' who will obtain a Country Court Judgment (CCJ). I have been given 14 days to settle.
What is my next move now.0 -

We are really blessed on this forum by muppets who should know the law but don't. They are after all owned by the disgraced Wright Hassall solicitors .... NUFF SAID ????
If you get a "letter before claim" come back here as they are bound to add on fake amounts as well

Hi, finally I have received a reply from Steve Clark asking me to fill in another form specifying exactly what Code of Practice had been breached and to supply the details of which Clause. Also, I must attach document/evidence to support my complaint.
Is there a sample letter that I can use on this forum to word this request efficiently, especially with the Code of Practice. Or can someone help me wording in details the complaint using legal facts please.0 -
Well the first bit is easy - what part of the CoP did they breach? You should know this0

Read the BPA CoP that was in force at the time of the alleged event.
Find the bit about not calling in debt collectors during the appeals process. State that no NTK has ever been received by the keeper, and the scammers have not produced any proof that they sent one.
You don't have to fill in any forms if you don't want to.
Have you found out where this alleged event occurred? If so, have you complained to the landowner yet.
Have you complained to your MP yet about this unregulated scam?

Even though it was dated 1 month before the ZZPS letter, it has been sent 45 days after the actual offense.
No proof has been sent as I am still waiting for the DPO reply.0 -

I have not complained to the landowner or the MP. I need to find out who own the land for that estate because the tenants are from the council but different Private companies bought the land where cars are parked.(if that make sense)0 -

I am going to read the letter again because I can't find anything stating BPA- CoP
To comply with POFA2012, if there was a NtD then the NtK must be served between 29 and 56 days from the day after the alleged issue. 45 days would eb within this if they sent a NtD. If they didnt, then was this a hire car? if so then it cannot be a NtK but a notice to hirer, legally speaking, and the timescale gets more awkward.0
