Parking charge - but I was driving past!

Hi - I have received a parking charge from Civil Enforcement Ltd. The camera photos show me driving along a road with double yellows and then half an hour later driving back the other way. I didn't stop - I'm just driving down the road!!
This a problem anyone else has had?

    Is it a private or public road to your knowledge?

    Are the CEL cameras fixed on poles/lampposts on the road, or on an adjacent car park?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Yes , has happened before , it's known as double dipping

    Appeal as keeper using the blue text template from the newbies faq sticky thread near the top of the forum , post #1

    No blabbing about who was driving , no putting your story , keep it simple

    Add a paragraph stating that the vehicle did not stop or park on that day and their pictures are flawed , as in their anpr captures and this will be brought up as fraud in court

    Save your ammunition for Popla or a judge

    Thanks. There is no story - I was driving down a road in a local town. I didn't stop - I drove one way on my way to a job and drove back half an hour later - and didn't stop. I'm literally just driving down the road! Its a public highway.

    I wasn't aware of a camera anywhere but based on the angle of the photo I'd say it was mounted quite high up. No - its nowhere near a car park to my knowledge.

    Personally I would be getting ammunition ready to fire at the landowner, GDPR and all that.
    If it was me, I would wait (beyond the arbitrary so called appeal window) to give the parking company reasonable time to rectify their mistake, then if they persist issue a data accuracy rectification notice in accordance with GDPR to both the parking comPany and the landowner

    Complain to the BPA online and give them the details , a copy of the PCN and state that CEL anpr cameras are catching people driving on a public road which is not allowed, without revealing who was driving

    So

    My vehicle was captured twice on a public highway by CEL anpr cameras which they have no right to do because it is not private land , ask them when the site was last surveyed and checked and what measures are taken by CEL to try to prevent these fraudulent PCN,s being issued

    So what are they alleging your 'infringement' is?

    Please tell us where this road is. Sometimes what people think is a public road is, in fact, private, e.g. an access road to premises which looks to all intents and purposes like a public road. I can't believe it's just any old public highway, else CEL would be dishing these out in their hundreds.

    Your approach to this will differ a little depending on whether it really is a public highway, or a private access road to somewhere (including a car park), and you happen to be going somewhere that isn't the controlled car park.

    Can you work out where the images were taken? If so, go back on foot and have a good look around. Take your own pics from various angles and distances when you find the scameras.

    Ask the council if the road is public or private.

    Are there any records of you and or your car at the place where you did the job.

    Please go back through this thread and answer any questions asked of you that remain unanswered. These questions are asked for a very good reason.

    If this is a public highway complain to Trading Standards.

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, as it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
