I have just received this email from BW Legal
Good Afternoon
Thank you for your recent email, the contents of which have been noted on file.
A Parking Charge Notice was issued against you for failing to display a ticket, not failing to purchase.
Our client need to be able to see the ticket that you have purchased to manage the site, otherwise individuals could claim any paper on their dashboard was a valid ticket. As such, as this was not visible to the Parking Attendant, the Parking Charge Notice was issued correctly.
Our client have stated you are outside of the appeal time as you had 28 days from the date of the contravention to appeal. As you have stated, our client has received your appeal, this was just not before 23 September 2019.
Please make a payment proposal for the full balance.

I stated the case C8GF30W7 Link Parking v Mr H. 14/11/2016 Port Talbot and told them the ticket had fluttered from my windscreen due to not having good adhesion, I also told them that had their 'inspector' looked in the vehicle on the seat he would have seen the ticket the right way up on the seat but sadly he didn't bother.
I have also told them I want the owner of the carparks name as this is now g=going to be taken to them to get them involved and let them see what a !!!!! comp[any they have working their carpark.0 -

You can find the landowner from Land Registry for £3.50, or by asking the Council ''who pays the non-domestic rates for that parcel of land''.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Owners details found on Landregistery and letter typed and in the post in the morning, now let's see what happens next. Will keep you updated0

I have contacted the landowner and the letter should be with them tomorrow.
I also had an email back from BW Legal which I will attach to this message, I asked them from information from their client asking for owners' details and also stating that a ticket fallen from a windscreen can be classed as flutter and also quoted the case that it was used in.
Their email is as follows:
Good Afternoon
Thank you for your recent email, the contents of which have been noted on file.
In order to use the facility it is your responsibility to abide by the Terms and Conditions. As the vehicle involved in the contravention was not displaying a valid Pay & Display ticket these Terms and Conditions were broken.
Please note, the signage in situ states:
“Vehicles must fully display a valid pay & display ticket in the front windscreen so all details can be inspected”
Therefore the terms and conditions were broken as no valid pay and display ticket could be seen on your windscreen and the Parking Charge Notice (PCN) was issued correctly.
As a result of the breach, Our Client is well within their contractual rights to issue the Parking Charge Notice and take all necessary steps (including bringing legal proceedings) to recover the outstanding charge.
Our Client does not intend to rely Schedule 4 of Protection of Freedoms Act 2012 and therefore the time scale is not relevant to this matter.
We can confirm that your Subject Access Request has been sent to Our Client who will contact you in due course.
Please also note that collections activity will continue and the current balance will be unaffected by this.
We trust this now concludes any outstanding queries you had raised with ourselves. It is important that you now contact us in order that we can discuss an affordable payment arrangement. Should you not wish to arrange and affordable repayment plan for this Outstanding Balance, we strongly recommend that you seek your own independent legal advice.

So what is my next move? As I said I have contacted the landowner and now await their reply, I asked them to consider contacting Armtrac to get this quashed, I also informed them of the bad reputation that Armtrac has.
I have just check the PCN and they have my vehicle as grey, on the DVLA website it is silver according to this:
7(1)A notice which is to be relied on as a notice to driver for the purposes of paragraph 6(1)(a) is given in accordance with this paragraph if the following requirements are met.
(2)The notice must—
(a)specify the vehicle, the relevant land on which it was parked and the period of parking to which the notice relates;
Does this count against them in any way?
