    Just a thought - "I am a witness to this as I was an occupant of the car as well as its keeper."

    Is there no point in including POFA 2012 No Keeper Liability in the POPLA appeal?

    Yes but only in the rare case that this PCN was a non POFA one, sent too late.

    And just to add, sorry!! I was posting on 2 threads at once before, and the other person was at 'comments' stage...and your post #3 was short and looked like they do at POPLA comments stage, LOL!

  • Thought I would update on this appeal and this is probably very useful information for anyone else with Parking eye tickets from university hospital of Llandough in Cardiff.

    Assessor summary of operator case
    The operator has issued the Parking Charge Notice (PCN) for remaining at the car park for longer than the stay authorised or without authorisation.

    Assessor summary of your case
    In summary of the appellant’s case she argues that the operator has not complied with British Parking Association (BPA) Code of Practice requirements. She advises that there was insufficient grace periods offered. The appellant advises that there is also no evidence of landowner authority. The appellant also states that the signage is inadequate. The appellant has attached a more detailed summary of her appeal.

    Assessor supporting rational for decision
    The appellant has been identified as the registered keeper. As the driver is unknown, I am will be therefore considering her liability for the PCN as per the requirements set out in paragraph 9 of the Protection of Freedom Act (PoFA) 2010 In this appeal the appellant has questioned landowner authority. In response, I have reviewed the operator’s evidence and I can see that it has enclosed a signed landowner agreement dated 28 November 2019. However, upon full inspection of this agreement I can see that whilst it does indicate that the agreement commenced in May 2019, I can see that it was not signed by the landowner until 2 days after it expired on 26 November 2019. Based on this factor, I am therefore not satisfied that this document is compliant with the requirements set out in section 7.1 of the BPA Code of Practice. As the operator has not provided any other documentation in relation to this point, I am unable to consider the PCN to have been issued correctly. Accordingly, I must allow this appeal. As I have allowed this appeal, I will not need to consider any other points made by the appellant.
