  • Yes, the exchange has happened as he got a letter confirming this.
    I am just going to ask him to check that his solicitor is at work on the day of completion and readily contactable. Thanks for all the info and help so far.

    Yes he got the list of questions and responded with all necessary documents etc but the solicitor kept saying she had not received various bits of info, and amongst other thinks it took around 3 weeks for the solicitor to confirm she had received his Mortgage offer etc. I think the solicitor was balancing too many clients at once. Anyway, the worst is over, hopefully ! and he will not be using that solicitor's company again !
  • Yes, I wonder why also. But as he got so far with the purchase/sale he was afraid to pull out and lose everything so he just put up with all the problems.


    In hindsight, you can change solicitors without scuppering the whole deal. The outgoing one just sends the paperwork to the new one. There would be some extra fees to pay as the new solicitor got up to speed with the paperwork but if the outcome is better, then it would have been money well spent.

    Can you learn how to quote on the forum please, it's really confusing when you just randomly reply to posts but don't quote them so nobody has any idea who you're replying to!

    The solicitor is not a clairvoyant. Presumably your son garnered most of this information when he originally purchased the flat? The solicitor is probably saving your son time and money by asking for this info. Unless you wanted to pay £300+ an hour for someone else to do the legwork?


    There is no such thing as a single source of information, hence all the questions. What the solicitor will have done is ensure the purchaser is in a financial and legal position to buy and your son will gain proper title to the property he is buying. That is their main role, not a runaround for all the odds and sods needed to make the decisions.

    The main thing that can go wrong from a practical perspective is that there is some damage caused to the property between exchange and completion. What follows is an argument about whether such damage was actually caused after exchange.

    The risk of non completion due to lack of funds is very small as most solicitors will not let a buyer exchange contracts without clearly knowing that they have the funds to complete. of course, it can always be the case that a mortgage offer is revoked, someone loses their job etc.

    That's typically why a shorter period between exchange and completion is better
    And also why the property itself should be insured by the buyer from the point of exchange.
