Removing a parking company from a business car park

What is the formal process to remove a parking agent from patrolling and giving out tickets in a business/residential car park?

My friends at VCS patrol a car park which you need a key to access. I was reassured by the managing agent that they 'didn't patrol the car park' so was shocked to see them last night giving out 'notices' like confetti. The notices they have issued this time are 'privacy notices' which claim 'Images of this vehicle and its registration have been recorded for the purposes of parking engocement'

Can all residents/business owners club together and get them removed? Is there a legal way to do this?

     Have you read this?

    http://parking-prankster.blogspot.com/2016/11/residential-parking.html

What does you lease/AST say about parking? Does it mention permits? Does it mention paying a parking parasite silly money if you do nor display one. If it is silent on the matter them your lease/AST has primacy and, if the are daft enough to take this to court they may get a bloody nose, read this

Nine times out of ten these tickets are scams, so consider complaining to your MP after the elction , it can cause the scammer extra costs and work.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

Can all residents/business owners club together and get them removed? Is there a legal way to do this?

The best way to get them banned is by voting them out at the AGM or calling an EGM. If access is controlled why do you need a scammer on site?

If this relates to the OPs other thread.

    https://forums.moneysavingexpert.com/discussion/5947305/county-court-papers-for-parking-in-own-business-car-park

Then reference to "residential" seems like a red herring as the OP appears to be a business owner leasing premises and two parking spaces.

The original one was resolved to my great satisfaction. I will post a copy of the privacy notice in a minute. :)
  • Ok, how do I post photos on here? :)
Does it have to be hosted on another site?

Try using Dropbox or Imgur to host it, as they are easy to use and share (and free).

This is the photo of the VCS privacy notice......... (hope it works)

I did a SAR and this is the blurb about their new notices which is automatically sent back by e-mail...........................

If you have found a Privacy Notice affixed to your vehicle, then this indicates that a Parking Attendant has reason to believe that your vehicle was parked in contravention of the advertised Terms & Conditions. To comply with relevant Data Protection Act Regulations, the notice is to inform you that your vehicle has been photographed and that the Registered Keeper of the vehicle may receive a formal Parking Charge Notice (PCN) through the post in due course. The PCN will include all the necessary details relating to the alleged contravention and also state how to Pay or Appeal the Notice.

IMPORTANT: Due to Data Protection requirements we cannot advise on the nature of the alleged contravention or handle any appeals until a PCN, if applicable, has been formally issued AND an appeal has been submitted in accordance with the instructions set out on the PCN.

You really need to get them removed, as you say. This is insidious and intimidating your staff and customers, delivery people, everyone.

The only way to get them removed is to complain to whoever contracts with them.

    Find out who contracts them
See if their contract interferes with your lease
If so, tell them to stop their agemntr interfering with your lease, or you will get a coutr to do so on your behalf
If not covered by a lease, point out the detrimental effect.
