RCIB Claiming money owed...

  • I'm not on here looking for loopholes to avoid paying... it's £30!! It's neither here nor there! I'm here to stand up for us little guys who constantly get bullied and pushed around by these big insurance companies and brokers!

Key question here, which has been alluded to but not responded on, was whether the terms and conditions of the original agreement in any way state that this is what would happen in the event of an insurer going bump. If so, you might feel that you accepted this at the point of taking out the insurance and should pay the money.

If there was no such term and they failed to inform you of what was happening at the time, I'd be inclined to ignore the first email and see what happens from there (if anything). They may feel that it's worth trying without too much expectation of getting money back from customers who have gone elsewhere.
  • On the contrary, had they told me that the underwriting insurance company had gone into liquidation I would have taken that opportunity to seek insurance cover elsewhere and been happy to wait for the rebate from the liquidators myself. The fact is, I was never given this option.

I'm sensing that a lot of the thoughts here are "It's only £30, what have they done wrong? Just pay it" - But it's the principle... they did not inform me that this was happening, and for them to chase me 2 years later for money is wrong. If they had given me the choice and I had agreed, I would comply and pay the money which is fair (assuming they can prove the shortfall). However, I was not given any choice whatsoever.

    Quite
RCIB have made a profit out of placing your business with a dodgy company
Why should you be the one out of pocket and not them?
I am the same as you and do not like to be told what to do.

The correct process the broker should have used was to inform you promptly of the bankruptcy and to seek your instructions on what you would have them do to maintain cover. They could state that they would presume that if they hadn’t received your instructions within a certain number of days then they would presume you do not wish them to take any action and that you would not be covered. They do not have the right to incur any costs over and above the premium that you had originally agreed to pay.

A few have suggested that it depends on what was in the terms and conditions. This is not entirely correct. Terms and conditions are not enforceable if they are unfair. In my view if there were terms and conditions in place that gave such authority it would seem that you would be obligated to pay any amount that they had demanded irrespective of how expensive that was. Such an open-ended obligation would in my opinion be clearly unfair and therefore unenforceable.

It seems thoughtful that they took the action they did, and good on them, but it was in my opinion at their risk and not yours.

    Good luck.
  • Hi, I've had a similar email stating I need to pay them £80.25. My policy ended 19 months ago, I don't own that car anymore and I paid all my monthly payments. Surely this is between RCIB and Alpha, not RCIB and myself?
  • Please stay away from them. This was the worst experience possible that I had ever for insurance service. I got a low quote but then when I wanted to cancel the insurance before inception. I was asked to call the customer care, which I did. and after the call, I was told that they will send an email that I need to confirm in reply. And I will be charged £60 to cancel the insurance without using it. Then I never received the email from their team(may be blocked by spam filter) and further calls I was sent another email to which I replied immediately. They waited for 3 more days to cancel the policy saying that the email was received late and charged me further for the one day of policy use. I have sent them the email proving that I replied to the email but they would do nothing.

I am taking time out to write this as I wish others to be saved even though I have lost £90 just for clicking on their insurance, I mistake I don't want anyone to do.
