If he comes back and claims it was definitely sent I think they are going to adjourn for a later hearing. Not sure what I can say against that other than balance of probability argument0

Update - Whilst they claimed to have sent electronce bundle to court, they said they had only sent to me by post.
It was therefore struck out, when they asked if I had anything to add I invited court to award costs and the judge initially wasn't going for this, and asked me for the broad arguments of my case I mentioned the signage points and that there were other arguments and also pointed out I was a key worker, this had caused enormous stress and loss of earnings and they awarded costs limited to half a days loss of earnings only. I tried to argue for greater due to the time input from me and the stress caused but they did not go for it.
Very happy with that outcome.
