            Finally got my day in court today (Wigan & Leigh Family Court) . . . . and . . . . (drum roll) . . . . Gladstone's a no show!
What an incompetent bunch and such a waste of Court's time.
The Judge struck the claim out on the basis that the Claimant brought the case and didn't bother to show up.
I asked for my costs to be considered and she agreed to the £95 wages allowance, mileage to court and parking fee. She would not agree to pay anything for my time putting the defence together, research, etc. But at least that means they have to get their cheque book out now
Disappointed that I didn't get the chance to win on the basis of my defence, but nevertheless a win is a win!
Thank you all so much for your help throughout (Coupon-mad in particular). Another one bites the dust 7 7

            Well done,
I really don't get why failing to show up, whe; you're the one who instigated it, isn't unreasonable behaviour. You've literally wasted the court and defendants time4

A win may be a win, but in my book you lost. All that time up the spout. Read this and see if you can waste some of theirs.

Thanks D_P_D but its gone on long enough. I prefer to look at it this way, if I hadn't spent so much time on it, my defence would not have been so good and maybe, just maybe, that's why they didn't show . . . because they knew they would lose against me! At the end of the day, I haven't had to pay their ludicrous penalty charge and instead they must pay my costs. It has cost them, therefore it's a win. It's all been an experience and hopefully I won't find myself in this unfortunate predicament again, but if I did, I wouldn't hesitate to take them on.4
