Heating fault reason to refuse/return car?

Yes, it does still have a warranty, but I don't want to be stuck with a car that will be in and out of the garage, warranty or not. Been-there-done-that, and its a major pain in the backside as we live in a very rural location and the dealer is very very far away. Usually the wait for a courtesy car is ages (I drive an automatic and they never have any) and I can't manage without a car whilst I wait for it to be booked in, so inevitably I still end up having to hire cars which costs a fortune.

All goes back to my previous post, if you want to use your short-term right of rejection the onus is on you to prove that an actual fault exists. .
There is no doubt that the fault exists- its easy enough to prove and very obvious. That wasn't really my question. My question was a point of law - there are degrees of fault from minor to catastrophic. Some sources (such as the CAB) say that within 30 days you can refuse a car if its faulty, and no mention is made on the faults degree, whilst other sources (such as honest john) say a car is returnable for a significant fault. But I'm finding it hard to unpick whether this is a) significant enought to be refusable and b) whether actually any fault, however minor is sigificant within the first 30 days. I was hoping someone might know where the line is.0 -
No one can tell you where the line is. The line is ultimately where a small claims court thinks it is, if it gets that far. If the garage do not agree with your view that it's a justifiable reason for rejection, your next step will be to formally reject the car, return it, the keys and the logbook to them and commence a small claims action to recover your money. If the SCC agree with you, you should get your money back. If they don't, the car will still be yours.0

What I would suggest is the following.
Phone the dealer, explain the problem and make an appointment to visit and ask if someone can have a look when you get there to see if they can do a quick fix.
If they manage to sort it whilst you wait then it was only a minor problem.
If however they can't fix it quickly and they need the car to be left for diagnostic or repair work, then in my opinion it's something more significant and worthy of being rejected.0 -

According to the manual I don't appear to have a pollen filter that is user serviceable either.

Thanks for the suggestion, but I don't think it sounds like the problem here. There is heating coming out where it shouldn't and not where it should. Where it does come out its strong and hot, its just not coming out of where it should be for the setting on the screen. The windows are clearing fine too. According to the manual I don't appear to have a pollen filter that is user serviceable either. Thanks though.
a very quick google search suggests its in /under the glove box, would be unusual I would think for a pollen filter not to be accessible
