Stuck / Dead Pixel on switch lite

Hello everyone I’m really looking for some advice here.
I purchased a Switch Lite console online from very.co.uk.
It arrived on Friday and out of the box it has a single stuck/dead pixel on the LCD screen. It’s not the end of the world but I’m not too happy to have this defect on a brand new product.
I contacted very about this who said my only option is to send it to them for a possible repair, this is the exact wording they use;
“In the event the item is repairable, it will be and then get sent back to you. In the event no manufacturers fault is found the item will be returned back to you. “
My problem with this is it will only be repaired if Nintendo deem this a fault, which they don’t;
*I tried to include the link but as a new user I can’t post links.
“Small numbers of stuck or dead pixels are a characteristic of LCD screens. These are normal and should not be considered a defect.“
Despite this purchase also being made online very have said it’s not eligible for a return, repair only.
“ Non returnable under our Approval Guarantee, once installed or connected. Your statutory rights are not affected. See Returns section in our Help pages for more information.”
So if I accept the possible repair, and it comes back and deemed not defective. I’ve basically got to accept the faulty product?
Any advise is appreciated.

You will struggle with this one tbh. They don't have a no dead pixels guarantee so 1 will not be classed as a fault, so it's not really a faulty product, although very annoying.0

Even if it's not classed as a fault, you still have the right to return the item and get a full refund (provided that you comply with the requirements of the Consumer contracts regulations):

Is that law or written in to Very's T&Cs?

That appears to be wording from Nintendo.
I don't think dead pixels are 'normal' or a 'characteristic'.
Twenty years ago perhaps that was the case.0 -
Yep, that is a quote from Nintendo’s website. Honestly I find it disgusting that it’s expected as normal.
Very have offered me a 10% discount to accept it in its current state now, or return for the “repair under manufacturers warranty”. Which will clearly just be returned to me in its current state dude to there being “no defect”.
Shall I just accept the 10% discount?0 -
Have you downloaded anything on to it or have you simply powered it up to check it out?
If it's the latter, contact Very again and tell them that you wish to return the item as permitted by the "Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013".
If the unit has only been turned on to check the appearance and functioning of it then irrespective of their own policies, they can't legally refuse a refund.
They will probably try and if they do, be persistent and they should eventually realise that they must accept the return.0 -

Unfortunately it had a system update applied and a game downloaded+played for an hour before the Pixel defect was noticed.0
