I bought a car on Salvage Auction without V5C or any registration document, this is specified on invoice l have.I promptly applied for the V5C including requesting for the car to be SORN. I received message stating l could not SORN the car as it was not in my name. DVLA acknowledged my car was off road in their letter and advised me to complete SORN when l receive the V5C in that letter they indicated the V5C would be processed on 15th November letter dated 1 November 19.
I was phoned by my wife today to say my car had been clamped, l still have not received the V5C, l still cannot SORN the car. To complicate things the car cannot be unclamped without Tax which l cannot apply for without V5C and l will have to pay £260 fine despite DVLA records showing they have my B5C application paid for but not yet processed.
I thought l tried to do everything right by the law but delays at DVLA have caused me this grief.Anyone understand and has advise on my predicament.

Where was it actually parked when it was clamped?0

Just outside my house l have no drive way so it was in the immediate road. Thank you for looking at the post and for asking.0

If it was in the road then I'm afraid they were entitled to clamp it as it's not off the road and was untaxed. You said in your opening post that the DVLA acknowledged the car was off the road though.0

You can't SORN a car that is on the public highway; it has to be on private land. If you have no driveway then you just cannot buy salvage cars and SORN them at all.0

They did say thank you for notifying it’s off road but you have to declare SORN on receipt of the V5C unfortunately l have not received the V5C to date paid the £25 have proof of date paid as paid by money order at post office.
It looks like the system is devoid of understanding context of the problem.l believe if not in use the car needs SORN otherwise Tax it but l could not do neither without V5C.0 -
But you wrongly notified them it was off road when it wasn’t. The system isn’t devoid of understanding, it’s there to prevent untaxed vehicles using the public roads, which includes parking. If you can’t tax or SORN a car, you must keep it off the highway and on private land. They don’t take into account whether or not people have driveways or garages. I’m afraid your error was to buy a car you had nowhere to store lawfully. I’m afraid the penalty seems entirely justified.0

It was not in use on the road it was parked in the road, the moment it was delivered by carrier it stayed where they clamped it.l promptly notified them it’s not in use their record shows that and it’s acknowledged.
When l follows up prior to the clamping they said it was responsibility of last owner to declare they had disposed it.0
