PCN Appeal Ignored??

Already did read it as per my original post. Nowhere does it cover an appeal being ignored....hence my questions.
You could complain to the BPA but it's usually a waste of time.
Personally I would send the template then put a complaint in to the BPA. If you neglect to send a second appeal then you will be chased for payment0 -

So...I screwed up! Did some digging whilst I had a few minutes and reinstated all my deleted emails and guess what, they have replied, I missed it, don't know how as I was on the look out for it but anyway I missed it. It has a POPLA code and the grounds for rejecting my appeal. I still think I have a case coz they keep going on about not being in a marked bay. Most of the spaces are not marked bays, just rubble!
My question, do I send the blue template contesting the NTK and ask for their evidence and go from there or go straight to POPLA? or am I too late for that POPLA code? (Issued mid October)

A POPLA code will last exactly 33 days (NO MORE) for example, I am about to put one in for someone where the rejection letter is dated 17th Oct.
POPLA appeal templates are in the 3rd post of the NEWBIES thread.
Is the NTK worded to comply with 8(2)f of the POFA? I expect so, but check.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you have even a few days you should be able to put an appeal together. Is there any chance of getting photos of the 'rubble spaces' (assuming they're still in the same condition? And the signs ... photos of them too ... look for those that are actually too high to read easily, areas of the car park where there are no signs at all, anything that illustrates difficulty accessing / reading them.
You would then embed those photos in the POPLA appeal to refer to.
Bit of a challenge but go for it if at all possible.0 -

Thanks, I do have photos and dash cam video footage and pictures of empty walls where there are no notices! I can put a case together but its which way to do it!0

You must have used the blue template appeal initially to get your POPLA code, so do as suggested in the NEWBIE sticky and reiterated by Coupon-mad just now and go to post # 3 of the sticky and pick the points from the templates for your POPLA appeal.My question, do I send the blue template contesting the NTK and ask for their evidence and go from there or go straight to POPLA? or am I too late for that POPLA code? I would be incredibly surprised if the POPLA code still worked. It would appear the ship has now sailed.
If my suspicions are correct all you can do now is sit tight and see if they issue a court claim.0 -

People who miss POPLA or whose case is lost at POPLA, just win in court instead.
