Drove onto Car park stayed 10 mins Ticketed.

Drove onto Car park stayed 10 mins whilst I met a friend and handed over something she had left at mine, didn't leave my car. I didn't pay.

Now Ticketed.....Euro CP.

So, is there any point in going any further or should I just pay up?

    Entirely up to you.

Why not read post #1 of the NEWBIES sticky thread to better understand your options?
  • Thank you. I will read through it however, I have been told ( by someone who was involved with Poplar) that in the past I would have grounds for appeal but that all that changed in the last few years and that if there is signage and you ignored it ( in my case it was dark and I don't recall seeing it) then a contract has still been formed. Is that incorrect?

What has Poplar (sic) got to do with it?

You haven't even appealed to ECP yet, have you?

I repeat, read post #1 of the NEWBIES thread to understand your options.

read clause #13 of the BPA CoP (download it) to see what the grace period is for a car park which is pay and display etc

in theory its 10 minutes maximum, which the government recently announced as a target to come in the near future

so 9 minutes would have been better , less waffle on site , get in , get the deed done , get out, so bear in mind for the future , or stay on public roads and not private car parks

if appealing , grace period is one of a number of appeal points if ECP issue a POPLA code

No, not appealed yet but have a relative who worked for Poplar (sic!) who told me the above. As I understand it Poplar are the next point of appeal if the ECP fails and they adjudicate. Is that not correct?

    Incorrect.

But you could try POPLA.

    In chronological order its

    1st option = landowner cancellation

2nd option = appeal to ECP as keeper

3rd option = appeal to Popla

Lastly = try to win in court , if ECP issued a court claim within 6 years

Yes it's correct but everything they told you is wrong...even the name of it:

    POPLA.

Please read the sticky thread first as this is ALL explained there already and we are going over unnecessary old ground here. You have so much to learn before you even try POPLA and (even if you lose at POPLA) you never, ever, pay ECP!!
