  • Hello everyone, me again.

    Do my husband received an email at 5pm today from Gladstones. We don't know how they got his email address.

    It is Without Prejudice save as to costs and the rest is as follows:

    Our Client has instructed us to contact you in relation to the above matter.

    Our Client has agreed to cease proceedings with both parties walking away from the Claim and bearing their own costs.

    This decision has been made for purely commercial reasons, in an attempt to save time and costs for both parties.

    Please confirm by no later than 12 noon on 26th November 2019 (tomorrow - tuesday)!if you wish to agree to the above by contacting craig@gladstonessolicitors.co.uk!and the relevant documentation will be served upon you and filed with the Court.

    I think that is good news: as yet we haven't incurred costs, frustrating as the whole thing has been. (I can still cancel my days annual leave from work and so can my husband).

    So 2 questions if anyone is kind enough to help:

    1. Am I missing anything in this, any trap in accepting it?

    2. How do I know they will definitely file the papers discontinuing proceedings at court in time - is there a way to check given that we are due in court on thursday? I just don't trust them!

    1) seems they want to avoid costs and expect to lose , no harm in acceptance


    2) check with the court or turn up, just in case, as if it was going ahead, check with the usher to see if its been discontinued and vacated
  • Thank you for your help. I was sort of hoping to avoid doing all the preparation and taking the day off work 😊

    Perhaps we could ask Gladstones to copy us in on the email to the court discontinuing proceedings?

    yep, why not , get it in writing, just ensure the court is also contacted beforehand , in case they are lying or its a ploy

    Yes I was about to suggest that your acceptance is conditional upon being copied into their email to the local court, attaching a Notice Of Discontinuance, or receiving a copy by first class post this week.

    Anyway you won, hooray! ANOTHER ONE BITES THE DUST!

  • Thank you so much! And for all your help and support - I nearly threw in the towel but I'm delighted now that we didn't! We will make that a condition when we reply.

    I did wonder if the email was from the SRA sharing our email, but it's possible it was from MCOL and I've forgotten we put it on there so I'm not too worried.
