County Court Papers - Local Parking Security LTD/Gladstones

Hi

We have today received county court papers issued 11th Nov 2019.

We parked at a retail park on 16/09/18, we were less than 2 hours but when we returned to the car we had a ticket, we ignored and explained when contacted by phone each time that we did not stay longer that the 2 hours specified.

The papers received today state; 'the driver of the vehicle xxx parked in breach of the terms of parking stipulated on the signage (the contract) at regent retail park (off site).


Any guidance much appreciated.

    Delete the incriminating penultimate line from your post.

    The advice to ignore has not been given since the law changed in 2012. I'm not sure how the scammers got your 'phone number but you should have blocked the number and never responded.
    I hope the driver's identity was never given.

    You now need to follow the guide to court in post 2 of the NEWBIES that was written by bargepole. This is a step by step guide from LBC to the court appearance.

    What happened when the keeper complained to the landowner?

    Please also complain to your MP about this unregulated scam.

    I have received these types of fines before and ignored them, however this was likely prior to 2012 and I wasn't aware of a change in the law.

    There are 2 of us that drive the car and we have never informed them who was driving.

    We never complained, is it too late to complain now?

    I will read the thread and follow the advice.

    With a Claim Issue Date of 11th November, you have until Monday 2nd December to do the Acknowledgment of Service. If possible, do not do the AoS before 16th November, but otherwise there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Monday 16th December 2019 to file your Defence.

    That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. No need to do anything on MCOL, but do check it after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure. Just file it.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    Does anyone have an example of a complaint letter/email to landowners and land owners? I have trawled the forums unsuccessfully. Would the following be suitable?

    Dear X
    Myself and my family visited the retail park on X September 2018. We returned to our car and were faced with a parking charge, we had been on the retail park for around an hour so assumed that it was an error.

    Today we have received court papers from solicitors on behalf of local parking security ltd who you have contracted regulate the parking on the site. We are appalled to receive court papers for using a local shopping park and staying within the time limit.

    We will contact the retailers, local groups and our MP if this is not resolved and would appreciate your help in this matter.

    I spent hours on there and just saw lots of examples of peoples experiences with complaints but no actual examples or templates, perhaps I was looking in the wrong place. Will take another look over the weekend.

    I submitted a request to stop processing data to the solicitors and as expected they refused.

    This is the response to the parking company in relation to the SAR, don’t they have to do this?

    [FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, or to all likely candidates now, it can cause the scammer extra costs and work, and often, if they know an MP is in the loop, they will cancel the charge..

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    I think a complaint to the ICO is in order. The parking company should have all the details (and data) about you and the parking issue and you should not have to go chasing their agents!

    There is a nice telephone number there for anyone to use when PPCs demand a phone number when contacting them!
