    If it were me, I would probably write to the bank loan provider with a SAR, to request documentary evidence of the default date and cause of action.

    This is probably best and if OP state what is wanted, as stated, then less likely to get a whole bunch of info not much use for this, like letters sent etc.

    Miked23 have you ever been in a DMP? Its just if it was defaulted in 2009 and as far as you believe no causal action then it would have been statute barred. However often it is a small payment, possibly a one off, somewhere in between that will probably be the reason they could apply for the CCJ. So it could be a payment from a DMP - or possibly some other source. That you didn't directly make any payment doesn't matter. No point contacting the court for info as minimal info would have been given for the claim to be issued and no info required when requesting a default judgement.

    Nic_c - I have never had a DMP and I’ve never made any payment to this. Also after checking through my credit report I can see every time my brother has applied for credit the search is in my file, all his addresses since he moved out of my mothers are also listed as my associated addresses.
    I’m in the process of removing his association and then I will send a sar to the original debtor. From there is it a N244 I need to have this set aside? And then on my court date I can prove this should be statute barred?

    I have read somewhere that the bank would lie about a payment made in order to secure the CCJ against me.

    They will be asked to produce information to show the payment

    It is the N244 form and there is a fee of £255 for it. You want to give clear indication of why, e.g. dates etc rather than just stating statute barred. Remember the six years for SB is up until the claim form was issued not the CCJ date.

    Have you requested the DSAR from the bank?
