Court Papers

Hello, first time posting here.
I have received court papers and would like to know if anyone can offer some advice.

I was under the assumption that only a sum totaling the original ticket amount could be sought. the paperwork seeks a lot more than this... is this grounds for the case to be thrown out?

Amount claimed £174.88
(comprising of £100 for the PCN, £60 contractual costs, £17.49 interest)
Court fee £25
Legal Representatives cost £50
TOTAL 249.88



I don't believe that the parking operator has permission to ticket cars on its land.
Part of the hospital land where I believe my car was parked was sold to a developer in 2014.
How can I prove if they have permission or not?

I appealed the ticket closer to the time and got no response.
I have emailed the parking operator asking for all data that they hold on me, but again... no response. (SAR). I sent to sales@ukparkingcontrol.com (the only email address I can find).

I have also requested info from Gladstones albeit no reply.

I have also filed an Acknowledgement of Service.

What are my next steps?

    You are right, they are trying tp claim for monies which the law does not allow, read this

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    You post images by using a hosting site such as imgur (not anything beginning with tiny) and past the link they give you replacing https://......... with hxxps://...........

    Ok so on my appeal, do I word something in line with..

    ABUSE OF PROCESS
    The Claimant is seeking excessive costs that go far beyond that noted on the original Notice to Keeper.

    I invite you to look at the following case:
    Claim number F0DP201T District Judge Taylor
    Southampton Court, 10th June 2019

    Should I mention about the fact that I 'think' that they shouldn't be operating on the land where I was given the parking ticket?

    The Issue Date is 07/11/19.
    With a Claim Issue Date of 7th November, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 10th December 2019 to file your Defence.

    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.


    When you are happy with the content, your Defence could be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.

    You would be wise to obliterate the claim number and your MCOL password from that image before someone files a rubbish Defence on your behalf. :eek:

    And also delete the pseudo link in post #2 above in case anyone brighter than me can work out how to view it.
