Is it enforceable ?

Morning all, apologies as know this is a busy forum just after a little advice...

My registered vehicle at wknd had a ticket from UKPC trial. It was on an industrial estate, but it was on the road into the estate not actually in any of the businesses spots, but explanation on ticket was "driver left vehicle"

The driver noticed the signs on the units so decided against that but there was nothing on the road or the fences where the vehicle was parked.

Just wondered thoughts and whether it's worth the appeal on the 25th/26th day ?

Cheers in advance.

They can only enforce this if they take you to court and win. The chances of that depend on your actions. All is explained in the stickies/FAQs and elsewhere on the internet.

    UKPC are fraudsters, read this.

    https://www.telegraph.co.uk/news/uknews/crime/11858473/Parking-firm-UKPC-admits-faking-tickets-to-fine-drivers.html

[FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP after the election, it can cause the scammer extra costs and work.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    "driver left vehicle" ??????
UKPC do tend to come out with rubbish which just adds to their fraudulent activity in the past by faking time stamps on pictures

    Were signs displayed ??

Appeal and ask for proof that A "driver left vehicle"
Could be the UKPC warden is a predator, especially to women
  • Signs were displayed on the buildings, but nothing on the road side...

I suspect the warden was an opportunist as it was left to attend a football match, and conveniently the time stamp was 3:15pm.

Is this a private or public road ?
  • It's hard to tell, but if i had to guess I'd say it's private as it was the same concrete floor that was in the car parks of the units... but again no signs up on the road itself and the driver wasn't blocking access to any gates or units.

Your council can tell you that and if they have planning permission to attach signs to walls
  • I'll give them a nudge and see what they say...

You need to get your own photographs of the signage, including one which clearly shows the wording of the sign. If other signs have different wording, a close up of those too.

Tell us what the sign says.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
