argos and faulty goods

Options
i bought an honor 8x phone in August 2019.

this week it stopped charging and will not charge up at all.

took it to the argos store i collected it from and they have told me to go directly to honor, i quoted the consumer rights act and the fact that my contract is with them as they sold me the phone but the manager refused to budge!

any ideas how to approach this? - currently without a phone, but feel frustrated that argos are just washing their hands of the issue and fobbing me off to honor.

The easiest way of solving things like this is usually leaving a comment on the argos twitter page.

The official way would be to send a letter before action.

Ive not dealt with Honor before but in some cases you can get a better result dealing with the manufacture directly over the retailer but it depends on the manufacture and what youd prefer in terms of refund, repair or replacement. Ie the manufacture wont offer the refund option. But then if you want that specific phone and argos dont have it anymore youll need to go manufacture to get the repair or replacement (theyre not obliged to legally, thats the retailer, but its not uncommon)

As Argos are a non specialist retailer, they have no repair facilities. So if you went through them they would send the item back to the manufacturer when they had the time. By going direct the manufacturer may be able to repair and return it more quickly

Your consumer rights are of course still with Argos
If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

First thing, you could insist Argos sort the phone out for you but generally it’s a lot quicker dealing directly Honer rather than waiting for the store to send it off
It’s over 1 month old so they can insist on having a repair and only if that’s not successful can you demand a replacement or money back
Dealing direct for phone repaired is generally very quick but legally they’ve up to 28 days from reporting to them returning it before it’s classed as unreasonable

i feel like i am banging my head against a brick wall.

phoned honor, they said argos should replace the phone. the shop manager still refused. called argos cs and they said that yes, given its only 2 months old then the store should replace. they refused. i called honor again and they also emailed argos to say that this should be replaced as a repair would take up to a month.

i am just confused because some parts of argos and even honor themselves are saying it should be replaced, but the manager is refusing.

i'm pregnant and i have a disabled 4 year old who has seizures - i cannot wait 28 days or longer with no mobile phone to use!

yes the store has offered a repair but honor and argos own customer service say it should be replaced. I don't have several weeks to wait for it to be repaired. Its only 2 months old.

They are entitled to repair the phone. You can't demand a refund.

Let them send the phone for repair and buy a cheapo unlocked phone that will do you until the Honor comes back.
That way, when yours does return, you will still have the cheap phone as a backup should you need it.
You can get a very basic phone for about £13

As you really need the phone to be working, if you can, consider getting something more reliable. I'm afraid going to the main phone makers does tend to give you reliability. Learned this the hard way lol.

I have had really unstable diabetes when pregnant, so had to have a working phone. So I do get it, not trying to be funny x x

It doesn't matter what Honor tell Argos, Argos get to call the shots on this.

Did you ask Honor why they won't replace It? it is their warranty after all. Argos have the right to have it repaired, it just take an extra couple of weeks going through them that's all.

It's all very well having a little knowledge about your consumer rights, but you have to learn that retailers also have rights.
