Ebay item faulty? Best way to sort it out?

I phoned Ebay yesterday and explained and was told Ebay know about the batteries not being allowed in the Royal Mail system and also said that Ebay returns system doesn't know that the buyer wants to return a battery as it just issue's a return label.
He said send another email to the seller explaing that i can't return the battery and see if they will recover it some other way and if nothing has happened after 8 days then Ebay will step in and refund. The seller has not replied to my email from yesterday or the one i sent at the weekend.
I will now wait and see what happens and thank you for the advice you have given me.0 -

As the 8th day arrives, ring eBay and tell them you have done as they asked - emailed the seller as the item cannot be returned in the mail. Tell them you would be happy with a refund from them now and pause until they make a response. Take it from there. Do not just escalate without another call. Pfaff I know, but you should get your money back as persistence is key with eBay.0 -

I called Ebay today and they have said the dispute will be in my favour as no response from the seller and i have tried to contact the seller to sort things out but they never responded.
The refund is in my Paypal account already so the email says.
