(NCP) NTK POFA Non compliant, instant win?

Hi, I've had a non compliant POFA letter from NCP (NTK was 3 months after offence with ANPR). I emailed the blue template, appealing as the registered keeper. I just wanted to check that I'm right in thinking they cannot come after me for the costs as they weren't compliant with POFA 2012 which means they cannot transfer liability of payment to me?
Further, if I write this and only this in my POPLA appeal which I'm sure I'll get soon, will they cancel the charge?

Yes. Should be an easy win at POPLA and NCP might give up now anyway!
Different wording would be needed if this is a hire/lease/company car.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
