Can an insurance company speak to a named driver

Can a insurance company legally speak to a named driver on the policy i.e when the policy is not in the person's name

My friend has a outstanding claim where he is the policy owner and his ex wife is named driver on her car....the car has been stolen, he has reported it but she is a bit mental and has called many times and contradicted herself around the details of the claim (i have requested and received the call recordings)

Question is as she is NOT the policy holder should the company have even spoken to her at all?

    I suspect it depends on what capacity she was calling. Is she a witness? More to the point, why are they discussing your “friend’s” claim with you?

  • They aren't discussing it with me, i have been in email and postal contact with them in the name of the policy holder as he is somewhat pathetic with admin. Just trying to help a friend

    He may have given permission when he took out the policy. Every time I phone my insurer to take out insurance they ask if there is anyone else that I want to give them permission to talk to about the policy.

    Who made the claim and who was in possession of the car at the time? Why is the ex wife even involved in this?

  • I would think they have every entitlement to speak to a named driver. The car has allegedly been stolen. They might want to ask her if she had taken it (since she's insured to drive it) or if she knows anything about its disappearance. Since she's been described as "a bit mental" (which covers a huge multitude of unfortunate conditions) she may well have taken it and forgotten where she left it. Who knows? The insurers certainly don't.

    I can't see that any data protection responsibilities have been breached. After all, there must be some relationship between the policyholder and anyone he has agreed to be a named driver on his policy. A named driver has a right - or more specifically an obligation - to ensure cover is in place before they drive the car so she should know almost as much about the policy as the policyholder does.

    There is clearly more to this than you are sharing.


    If the car was stolen then they can speak to anyone involved with the policy to ask them if they know about the incident. If she's said anything and contridicted herself it's her own hole she is digging.
    However is she is telling a differnt story to the policy holder it suggests that "stolen" might be something else that you are not telling us about.


    For example her driving it without policy holder permission and thus him reporting it stolen? - if I had to guess.

    As you say it's her car, I would expect them to talk to her.

    i know what happened from my friends side and i am merely trying to help him - i am not on either 'side' and tbh i am sorry i even posted on this site as nothing helpful
