Outrageous PCN - PayMyPcn

Hello all.
Thanks for this forum. It's great. I've read the newbie thread.
I recieved a PCN from PayMyPcn / CompleteParkingServices Ltd claiming a vehicle of which I'm the registered keeper parked on private land (under 20 minutes).
What actually happened is driver entered the road(private but open) of a popular waterfront location in my city, drove along the watrefront, saw the 'Residents Only Parking' signs, so after some discussion in the car the driver left the private land and parked on a public street down the road. Driver and occupants didn't exit the vehicle.
They want £100 reduced for £60 for this pleasure.
The APNR camera footage just shows the vehicle on the road, not parked up.
Here's my plan:
- Appeal the PCN, not list a named driver, using a MSE template.
- If the Appeal fails read but ignore the follow up letters. Figure out a valid defense.
- If necessary get some legal representation if it goes to small claims.
What do we think? Please can you guys help?
Thanks in advance:beer:

IPC member , so correct apart from the last part
its not worth paying a large amount of money for a solicitor to represent you , even if you found one with the competence and willingness to take it on , at an extremely low price or pro bono
I doubt there are many who would even understand this topic, let alone represent you without charging several hundred pounds
so appeal once , as keeper , then ignore anything except an LoC or Court Claim within 6 years , keeping all paperwork in the meantime0 -
Providing it is the template appeal written in BLUE text in the NEWBIE sticky post # 1, that will be fine.RizzlePeezy wrote: »Here's my plan:

Thanks RedX, Le_Kirk. Appreciated.0

Please may I ask in the event of losing the small claim case how much £ would I be looking at? Thanks again.0
-
typically its £175 to £200£100 - original parking charge
£25 - court filing fee
£25 - hearing fee, if it gets that far
£7 or £8 interest.
£50 - solicitor costs for preparing case papers (maximum, capped) - where applicable
So not much more than £200 - IF YOU LOSE!
Anything else they try to add will be spurious and must be challenged with the Judge.
IF YOU WIN - none of the above will be payable by you. But you could claim:
£95 capped maximum for loss of earnings/annual leave for half a day (take pay slips for proof)
Travel costs - public transport or mileage x 45p per mile
Parking costs.0 -
Thanks RedX. That reassures me that it's worth the gamble. I'm going to fight this.0

See you in 2020. Court is the stage when you win (if they try). Tiny firm:
Never actually heard of them...!CompleteParkingServices Ltd
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
