Kernow Parking Solutions IPC, Gladstones Solicitors and the DVLA

In October 2019 we successfully bought a claim against The Department of Transport (DVLA) for breach of our personal data to the scum that is Kernow Parking Solutions. The award of the court was £250 plus costs - very little money but a massive win in our opinion. Thanks to this forum, and someone's FOI request it was stated that KPS had not been struck off the IPC register (as I had said) but had simply not continued with their membership. Following investigation we received a letter written by IPC that KPS's membership expired on 31st January 2019. KPS requested our details on 30th January knowing that the DVLA would not receive the request until the 31st January at the very earliest and DVLA take at least 5 days to process a manual request. KPS then used our details to pursue us for a parking charge notice (that it obtained by deception) knowing that it was not a member of the IPC.
An important point is that on the V888/3 Form we requested from the DVLA there were at least 5 other victims at the same time (details blacked out on our copy) and these drivers would also have a valid claim against the DVLA, IPC and Kernow Parking Solutions. Robert Ley is trying to get his parking company struck off the Companies House Register but we have objected and his applicatioin is on hold as of today. We have a claim against KPS and it is an offence to dissolve a company in the knowledge that there is a claim outstanding.
As I explained previously, IPC did not remove KPS from the register until I demanded it in April 2019. Between 31st January and April the IPC was negligent in misleading motorists into thinking that KPS was a member of an ATA when it was not.
The conflict of interest with regards to the IPC is too lengthy to go into here at the moment but with the directors/shareholders/common (invalid) addresses, hearing of appeals etc, I question that the DVLA allows the IPC its ATA status. IPC is not fit to have this power over the release of people's personal data - and I am personally investigating William Kenneth Hurley and John Llewellyn Gladstone Davies' practices and business interests where the DVLA has failed in its duty to.

When you say 'we' brought a case against the DVLA, was this a company or an individual who filed the claim? Can you tell us the court, claim number and parties' names, plus the Judge who allowed the case, so people can quote it, and what do you recall the Judge said?
What did the IPC say, if anything, to explain why they left Kernow on the list till April? Couple of typos in my message that I was going to amend - fast response on your part! We brought the claim - I mean my husband and I (I was his lay representative and also witness). The court was Truro County Court (Claim Number F4QZ3J15). The DVLA sent a barrister. The case was won on the point that it released our data to KPS when KPS was not a member of an ATA. We have brought a case against IPC for negligence - but for the IPC's actions in not informing the DVLA that KPS was no longer a member, the DVLA would not have released our details.0 -

The IPC was trying to be supportive of KPS in saying that they were not struck off and complied with all rules regulations when in fact it helped me prove that they had not been compliant with the main criteria - that KPS MUST be a member of an ATA and it wasn't.0 -
Obviously KPS was not compliant with the IPC's Code of Practice in that it used predatory tactics but the IPC is trying to gloss over this.
Vicky Jarrett, IPC's Complaince Manager refused to respond to the complaint - it was pretty damning.0 -
Send a copy of the judgment when you get it, and of your complaint and IPC's reply about their conduct, to Luke Hall - a current DCHLG minister who is actively involved in the new CoP:

Hope you do not mind clarifying this:-

An email was sent to a local court a while ago asking them:-
"Is it in order for a witness, who is producing a statement supporting the Claimant, also acts as a Lay Representative so that the Claimant, while attending the hearing, does not have to speak?."
They replied:-
"A witness providing a statement in support of a claimant does not have right of audience to address a judge on the claimant’s behalf."
I was wondering if the Truro Court made any comment regarding witness also acting as LR?0 -
I think a Judge can allow it, and that isn't actually saying a witness cannot also happen to be a lay rep. Some idiot once tried to tell me it was precluded but the person was a legal wannabe waste of space (aka a sad git) and IMHO, was wrong.PRIVATE 'PCN'? 1505 Grandad. On the allocation questionnaire completed months ago I was included as a witness (in number only) as I was present at the time of the scam. After reading posts on this site I realised I could act as lay representative and did not submit a witness statement. A letter was handed to the court on the day and the DVLA barrister did want to check the position but it was allowed. It would have put my husband at a serious disadvantage otherwise, I cannot tell you how many hours I have spent on this and know the facts backwards!0
