If a Defence is not recorded as 'received' on MCOL, then anytime after the due date the Claimant can seek a Default Judgment against you. That's an automatic process.
Of course if you have an email acknowledgment of receipt by the CCBC, then it will be possible to 'unwind' the CCJ but it will be a bit of a faff.
Why don't you file your Defence now rather than procrastinating further?
The sooner you file the Defence the less likelihood of things getting out of step.
You've had a good Defence waiting to be filed for weeks now.
I don't have a scanner. Will have to get it scanned, converted to a PDF and then attach to an email tomorrow morning.
Given the short time window, would you file via MCOL site just before the deadline, if CCBC not sent acknowledgement? Just asking what you would do, at this point
Or should I post it first class to CCBC now??0 -

Return your completed DQ to the CCBC in the same manner and to the same email address that you sent your Defence. refresh your memory on that by re-reading post #9 above.

Cheers Keith, will do. Could I double check something - I will be accompanying my partner to court (he got the parking ticket). Does this mean I should put down '2' for witnesses in section D3 - although I probably won't say anything?
