I changed the last paragraph from

. In summary, it is the Defendant's position that the claim discloses no cause of action, is without merit and has no real prospect of success. Accordingly, the Court is invited to strike out the claim of its own initiative, using its case management powers pursuant to CPR 3.4.

    To

. The Court is invited to make an Order of its own initiative, dismissing this claim in its entirety (due to the similarities with the Southampton case where the entire claim was deemed 'tainted') and to allow such Defendant's costs as are permissible under Civil Procedure Rule 27.14 on the indemnity basis, taking judicial note of the wholly unreasonable conduct of this Claimant.

Shall I leave it like that or keep the first on or use both?

Thanks again. for your help. I've got to go back to work but can look again in an hour.

I always thought that "in summary" should be last; you could always roll it up with "invite the court to dismiss........."

You need to file your Defence today.

Less than one hour to go.

    Hi all,

I sent my DQ to ccbcaq@justice.gov.uk & to VCS.

I received an email from BW LEGAL stating:

We can confirm the matter on our end has been closed for sometime now, you will need to send this directly to the client to deal with this further and to contact them if I need any further assistance.

Does this mean my case has been closed?

Who would be the client I would have to contact?

Thanks again for all your help!

Who was named as filing the claim, on the claim form, BW Legal? OR NOT?

I do not mean the Claimant, I mean who filed it, whose address was given for service of papers like your DQ?
Who would be the client I would have to contact?
Errrmmm, I can't believe you are asking that. The Claimant, of course and that is NOT BW Legal! The parking firm...

Vehicle Control Services is who name is on the letter and that is who I emailed that why I am confused on why I got an email from BW LEGAL, as I wasn't sure they were part of the same company.
