EMA BP Petrol Station PCN from VCS

I've had a search on the forum and cannot find anyone talking about defending a PCN from VCS on BP Petrol Station

I was running late picking up my members of my family (over an hour) and pulled into BP petrol station because they had walked over there.

I pulled up outside the water and air machine where there were no red lines. I did want to use the machine but it had no power. They came up and to me and loaded luggage. I stopped for around 1-2 minutes at most.

I did not see any signs at the time but on the photos they sent I can see this behind me and my relatives. Do I have have a leg to stand on?

    The only way this is likely to be resolved is if you're resilient, do your research, deal with all the paperwork likely to come your way, and ultimately defend yourself in court. They have 6 years to sue in the civil court. VCS are litigious.

    There is no silver bullet.

    many thanks for your reply. So it makes no difference to it being at the petrol station itself? so the bylaws can still be used? I could not find any information on this

    If the petrol station is on airport land which is what you have suggested , then bylaws apply

    If it's not on airport land , then bylaws do not apply

    You stated it was a BP petrol station at EMA , EMA is an airport , so if true then bylaws apply

    EMA and Southend seem to be new or recent contracts for VCS , whereas LJLA and RHA airports have had their infestation for years

    Check the bylaws and boundaries for EMA , decide if the BP garage is within the boundaries or not, then you will have your answer

    I agree that it probably isn't , meaning this is no different to any other petrol station PCN , BP or otherwise , near to an airport or not near to an airport

    VCS routinely reject appeals regardless , so no magic bullet

    East midlands Airport operations manual "Aerodrome manual", page 91 begs to differ see page 91 here :

    If you look at that picture, where it says EASA- Land ownership


    Directly above the A of EASA you should see a road leading up into the airport, follow this and there's a round about, the petrol station is just above this ( ie north) well within the blue boundary.

    The problem with east midlands airport, is since the imposition of the draconian no stopping enfarcement is that its caused issues elsewhere, Leicestershire county council have also placed real double reds on the road that runs alongside, with more restrictions to follow, from what i've heard restrictions may also be coming to nearby villages such as Diseworth - which i have used as a base to start a few walks/hikes in the surrounding countryside.
    So VCS at the airport, has had a knock on effect on the A453 outside, which in turn is having a knock on effect in the neaby villages - a sort of ripple effect that spreads far beyond the airport itself.

  • Thank you so much for all the information. I have decided to let a company fight this for me. I have not got the time to do the hours of research but do not want to give VCS money for what seems to be very unfair. I will keep you posted to the outcome
